Case of Leonarda Dibrani

The Leonarda Dibrani case relates to the political unrest in France in October 2013 that arose around the deportation of Leonarda Dibrani, a young Roma from Kosovo .

Leonarda Dibrani was 15 years old at the time of the crime. Her family is originally from Kosovo, with her mother and siblings all born in Italy. Her family lived in Fano / Italy until 2008 . The children were regularly absent from school and were sent begging. The father, Resat Dibrani, could not be integrated into working life despite the efforts of the city of Fano and was mostly fired for behavioral reasons. He earned his extra income as a scrap collector. He had a criminal record for theft, fraud and violent crimes.

The city of Fano planned to deprive the children of the child's welfare. The family fled to France in 2008 to avoid deprivation. Upon arrival, the parents burned all documents and passports and filed asylum applications. Discrimination as Roma in Kosovo was given as the reason for needing asylum. When the real origin came out, the asylum applications were rejected as manifestly unfounded. Attempts to legally challenge the asylum notices failed, so that finally the deportation was decided.

Since minors cannot be deported without a guardian, the family dispersed to different accommodations, so that a joint deportation was initially impossible. Resat Dibrani was deported alone 2 weeks before the incident. The mother and children were located, arrested and deported. The student was arrested while on a school trip. This led to the nationwide protests.

The unacceptable offer of French President François Hollande for the ensuing crisis, in the opinion of those affected, has led to fierce criticism from all sides, including his own socialist party.

Jean-François Copé , party leader of the second largest party in France's UMP , then announced that he would propose a new law on the birthplace principle in France. The next day, Interior Minister Manuel Valls announced that President Hollande wanted to adapt the asylum law in order to avoid similar cases in the future.

The fall in April 2014 of Harlem Désir , the former president of the French Socialist Party, was explained in part by his inappropriateness during the Dibrani case, when he expressed his hope that not only Leonarda but other members of her family would be allowed to come back to France.
