Case of the "healer of Bern"

In the case of the "Healer of Bern" , an Italian - Swiss music teacher and operator of an unauthorized acupuncture practice in Bern is said to have intentionally infected at least 16 people with HIV and 14 of them with hepatitis C as part of a "healing activity" .

The alleged acts occurred between 2001 and 2005. A manager who had been stabbed in the back by the alleged perpetrator during treatment in 2004 and who had suffered an HIV infection initiated the investigation in 2004. However, his information was only followed up from 2005 after the suspected cases in patients in Bern's Inselspital had increased. The 16 affected persons examined were infected with an HI virus from the same strain. The alleged perpetrator is said to have taken the blood for years from an HIV-positive man whom he had faked a possible cure. According to the indictment, the infected people also include two ex-girlfriends of the alleged perpetrator.

The trial of the first instance at the regional court in Bern-Mittelland began on March 6, 2013. The alleged perpetrator denied any involvement in the infections. During the trial, he holed up at his home from the police for 24 hours instead of attending the trial. He was then arrested. On March 13, 2013, he was sentenced to 12 years and 9 months in prison. His lawyer appealed the verdict and the public prosecutor followed him up with a cross appeal . On April 11, 2014, the sentence in the appeal process before the Higher Court of the Canton of Bern was increased to the highest possible prison sentence of 15 years. The alleged perpetrator moved the case to the Federal Supreme Court , in April 2015 the court upheld the prison sentence (decision 141 IV 97); the defendant's motion to be acquitted of the charge of aggravated assault and possibly convicted of minor assault and spread of human disease was denied.
