Gerhard Fezer

Gerhard Fezer (born October 29, 1938 in Tuttlingen ; † August 15, 2014 in Hamburg ) was a German law scholar and professor at the University of Hamburg .

Life

Fezer began studying classical and German philology at the University of Tübingen in 1958 , but switched to law in 1961 . He finished his studies in 1965 with the First State Examination in Tübingen, followed by the Second State Examination in 1968. He then worked as a judge at the Tübingen regional court before returning to his academic career in 1969 as Jürgen Baumann's assistant . Fezer received his doctorate in 1970 under Baumann as Dr. iur. and was then seconded to the Federal Ministry of Justice as a public prosecutor . In 1974 he completed his habilitation in Tübingen and received the venia legendi for the subjects of criminal law, criminal procedure law and civil procedure law.

Fezer then worked briefly as a lecturer in Tübingen before accepting a position at the University of Münster in 1976 . In 1978 he switched to the chair for criminal law and criminal procedure law at the University of Hamburg , which he held until his retirement in 2004. Since 1981 he was also a part-time judge at the Hanseatic Higher Regional Court in Hamburg .

Works and works (selection)

Fezer devoted himself in his works in particular to criminal procedural law. Here, he paid particular attention to the law of revision ; his habilitation thesis is considered a standard work on this topic. In addition, Fezer developed his own teaching on the prohibition of the use of evidence in criminal proceedings . He was seen as an advocate of a liberal, constitutional approach to criminal procedure law.
