Gerhard Herbst

Gerhard Heinrich Herbst (born September 15, 1928 in Regensburg ) is a German lawyer and former President of the Bavarian Supreme Court .

After studying law , in autumn 1955 the University of Munich became a doctor of law with the civil law work “The standard of negligence in civil law”. iur. PhD . After completing his legal training in 1957, he joined the Bavarian judicial service as a court assessor and was seconded to the Bavarian State Ministry of Justice . This delegation was initially retained when he was appointed public prosecutor at the Munich public prosecutor's office in 1959 . From 1960 to 1962, Herbst worked as a judge at the Munich District Court . From 1962 he worked again at the Bavarian Ministry of Justice, initially as a senior government councilor and from 1965 as a government director. In 1969 he worked for a year as a judge at the Munich I Regional Court before returning to the Bavarian Ministry of Justice. There he was in 1970 Ministerial , 1977 Assistant Secretary . From January 1, 1988 until his retirement on September 30, 1993, Herbst was President of the Bavarian Supreme Court and at the same time a member of the Bavarian Constitutional Court . In addition, he worked alongside Peter Bassenge as co-author of a commentary on the FGG and the RPflG .
