Harbor Security Act

Some German federal states have passed port security laws that regulate security in ports and port facilities. They are used to execute and implement the requirements of the following international regulations, unless they already apply directly:

  • Directive 2005/65 / EC of the European Parliament and of the Council of October 26, 2005 to increase security in ports - Port Security Directive - (OJ L 310 of November 25, 2005, p. 28), which was amended by Regulation (EC) No. 219 / 2009 (OJ L87 of 31.3.2009, p. 109) has been changed,
  • Regulation (EC) No. 725/2004 of the European Parliament and of the Council of March 31, 2004 to increase security on ships and in port facilities (OJ L 129 of April 29, 2004, p. 6),
  • International Convention of 1974 for the Protection of Human Life at Sea of ​​November 1, 1974 (Federal Law Gazette 1979 II p. 141), which was last amended by law of December 22, 2003 (Federal Law Gazette 2003 II p. 2018) ( SOLAS- Convention ),
  • International code for security on ships and in port facilities (Federal Law Gazette 2003 II S. 2018) ( ISPS code ).

The scope of the Port Security Directive covers all ports in the territory of a Member State that contain one or more port facilities covered by an approved port facility security plan in accordance with Regulation (EC) No 725/2004. It does not apply to military port facilities.

In 2015, the European Commission decided to refer Germany to the European Court of Justice (ECJ) for not fully applying the provisions of Directive 2005/65 / EC to increase security in ports in the state of North Rhine-Westphalia .
