Open execution

from Wikipedia, the free encyclopedia

In the case of the open execution , in contrast to the closed execution, no or only reduced precautions are taken against escape . This requires the inmate to voluntarily classify himself into a system of self-discipline, community ability and self-control and is the last and most important stage for “practicing the rules of free life” ( rehabilitation ).

Ideally, this means specifically: The prisoner leaves the prison in the morning and goes to his workplace. After finishing work, he returns to the institution immediately and stays there until the next morning, provided he has no leave or vacation. In the institution, the prisoner can take part in the leisure, sport and treatment measures offered there; he spends most of the weekends with his family. The prisoner in the open prison has to strictly adhere to the given rules. Alcohol consumption or a delayed return can quickly lead to a prisoner being transferred to a closed prison.

Germany

As of March 31, 2014, of the 54,515 prisoners in Germany, 45,574 (83.60%) were in closed and 8,941 (16.40%) in open prison. The proportion of prisoners who returned late or not voluntarily after exits is less than 1 percent. That is less than 100 cases per year in Berlin.

Legal background

With his consent, a prisoner should be placed in an institution or department of the open execution if he meets the special requirements of the open execution and in particular there is no reason to fear that he will evade the execution of the prison sentence or abuse the possibilities of the open execution for criminal offenses will.

As a rule, only first-time offenders are accommodated in an institution of open prison, but depending on the federal state , very different criteria and standards can be decisive for admission to open prison. The prisoner receives a summons to begin his sentence. He can file a pardon before commencing his sentence, whereby he must give valid reasons for this. However, only in the rarest of cases is a request for clemency approved. In addition, under certain conditions (illness, death in the family, etc.), the prisoner can postpone the date for starting his sentence. If he does not follow this summons, he will be put out for a search and will be taken to the closed prison after the arrest and will remain in the regular prison until either his suitability for the open prison has been certified again or he is released from the closed prison. After starting prison in the open prison, the prisoner may not leave the prison (open prison) until his suitability for the open prison has been determined. Aptitude is checked by the prison social workers and must finally be approved by the prison director. The aptitude test usually lasts 14 days. Only after the suitability for the open execution has been determined, the prisoner first exits are approved. If the prisoner proves himself during this time, he will then be allowed to take up work outside the institution. Here, however, the prisoner's new employer is carefully checked in that the social worker responsible for the prisoner personally visits the employer. Only then can he start his new job. In addition, the social worker visits the prisoner at regular but unannounced intervals after starting work in the company to check whether the prisoner is still employed there and asks about the current situation. Basically, it can be observed that stricter standards are applied in the southern federal states such as Bavaria or Baden-Württemberg , while in the northern federal states such as Berlin , Bremen or Hamburg a more liberal practice is common. Are not suitable for open prison particular addiction- and aligned vulnerable prisoners, prisoners, one in the past, enforcement easing (exit and leave) have abused, and prisoners against whom a deportation, extradition, investigation or criminal proceedings.
