Hans Berger (Manager)

Hans Berger (born April 22, 1950 ) is a German manager and was CEO of HSH Nordbank from January 1, 2007 until his resignation on November 10, 2008 .

Professional background

Berger has been a board member at Sparkasse Kiel since 1986 . In 1996 he moved to the board of directors of Landesbank Schleswig-Holstein (LB Kiel), from 2003 he was chairman of the board. After founding HSH Nordbank , which arose from the merger of the Hamburgische Landesbank with the Landesbank Schleswig-Holstein, he took over the position of deputy chairman of the board. Effective January 1, 2007, Hans Berger succeeded Alexander Stuhlmann as CEO of the bank.

In the course of the international financial crisis in 2008 , HSH Nordbank slipped into the red. On November 3, 2008, HSH Nordbank announced in a press release that it would apply to the Financial Market Stabilization Agency for a guarantee of up to 30 billion euros. On November 10, 2008, Berger then resigned from his position as CEO. His successor was the previous board member Dirk Jens Nonnenmacher .

Years later, Berger had to answer in court for the "Omega 55" project decided by the HSH Nordbank Management Board in December 2007. It was a special purpose vehicle founded jointly with the major French bank BNP Paribas. The French partner had, among other things, brought Icelandic government bonds and Lehman papers, which led to losses in the financial crisis, into the company. Six former directors were charged with breach of trust; the damage was put at 158 ​​million euros. The trial began on July 24, 2013 at the Hamburg Regional Court and ended on July 9, 2014 with an acquittal for all of the accused. Following the appeal by the public prosecutor's office, the Federal Court of Justice overturned the judgment on October 12, 2016 and referred the proceedings back to the Hamburg Regional Court for a new hearing.

Until November 10, 2008, Berger was a member of the Board of Directors of DekaBank Deutsche Girozentrale .
