Hartmuth Horstkotte

Hartmuth Horstkotte (born April 14, 1931 in Hamburg ; † November 1, 2015 in Berlin ) was a German lawyer and judge .

Career

Horstkotte passed the state law exams in Hamburg in 1954 and 1959. After his appointment to the district court advisor in Hamburg in 1962, he was seconded to the Federal Ministry of Justice . 1966/67 he was a research assistant at the University of Bonn . In 1968 he was promoted to regional court director during a renewed secondment to the Federal Ministry of Justice. In August 1969 he was appointed Ministerialrat. As head of the criminal law department, he was involved in the preparation of the major criminal law reform. He did the preparatory work on demonstration criminal law, sexual law and abortion law. He represented the Ministry's drafts in the committees:

“But we were all satisfied by Ministerialrat Dr. Horstkotte with admiration. His crystal-clear, print-ready language and his keen legal understanding could hardly be surpassed. He knew all of literature. But if he was ever overwhelmed, which was seldom enough, he wouldn't let himself rest until he had found even the most remote places and submitted them to us. "

Horstkotte was also active in sub-committees of the Council of Europe as a representative of the Federal Republic of Germany. In 1975 he was appointed to the Federal Court of Justice . He was a member of the 5th criminal senate in Berlin. He was a reporter in wall rifle trials , in decisions on perversion of the law by the GDR judiciary , and exploitation bans , especially in the absence of information on the accused .

He was a commentator on the 10th and 11th editions of the Leipzig Commentary . Horstkotte, who holds a doctorate in law, was a lecturer at the Free University of Berlin and worked on international committees.
