Herbert Schimansky

Herbert Schimansky (born June 22, 1934 in Berlin ) was a judge at the Federal Court of Justice from 1982 to 1999 .

Herbert Schimansky joined the judicial service of the state of North Rhine-Westphalia in 1962 after completing his legal training (studies in Frankfurt am Main and Bonn; internship in the OLG districts of Cologne and Hamm) . After working at the Essen District Court and Regional Court as well as a two-year secondment to the Federal Ministry of Justice, he was appointed regional judge in Essen in 1965 and higher regional judge in Hamm in 1971. In 1972 he was transferred to the Düsseldorf Higher Regional Court at his request. After being appointed presiding judge at the Higher Regional Court, he took over the chairmanship of an appeal and first-instance criminal panel there in 1981.

In May 1982 Herbert Schimansky was appointed judge at the Federal Court of Justice and assigned to a criminal division there. In addition, from 1983 he assumed the duties of presidential judge of the Federal Supreme Court. When a new (XI.) Civil Senate was founded in mid-1988, to which the essential areas of banking law were gradually assigned, Schimansky became its chairman. In addition, he was chairman of the federal service court from the beginning of 1992 to the end of 1996.

Herbert Schimansky retired on June 30, 1999. On this occasion he was awarded the Federal Cross of Merit by the Federal President . His eleven years as chairman of the banking senate is recognized by a commemorative publication entitled “Banking Law - Focuses and Perspectives” (editors: Norbert Horn , Hans-Jürgen Lwowski and Gerd Nobbe). His successor in the chairmanship of the XI. Gerd Nobbe joined the civil senate .

Herbert Schimansky is co-editor and was co-author of the banking law manual, which was first published in 1997 (Schimansky / Bunte / Lwowski , banking law manual, currently 5th edition 2017). He has been a member of the Board of Trustees since the Bank Law Association was founded in 1989, from which he retired in 2009 for reasons of age. In addition to Professors Hopt and Hadding, he was co-editor of the publication series of this association. From 2000 to 2008 he was chairman of the arbitration tribunal of the DVFA (German Association for Financial Analysis and Asset Management).
