Ingolf Viereck

Ingolf Viereck (born January 4, 1962 in Wolfsburg ) is a German SPD politician . From 1994 to 2008 he was a member of the Lower Saxony state parliament .

Life

After studying political science and history without a degree, Viereck has been a commercial clerk at Volkswagen AG in Wolfsburg since 1990 . In 2001 he was the SPD candidate for the office of Lord Mayor of Wolfsburg. He was defeated by the CDU candidate Rolf Schnellecke . Furthermore, from 2001 to 2005 he was one of the three equal mayors of the city of Wolfsburg.

Viereck continued his employment on paper at Volkswagen even after his election to the state parliament and received salary from Volkswagen until January 1, 2005. On July 1, 2005, part-time employment was resumed. VW boss Bernd Pischetsrieder wanted to end the employment relationship with the two SPD members of Lower Saxony, Ingolf Viereck and Hans-Hermann Wendhausen . For ten years, the two had collected a second salary from VW parallel to their diets of 5400 euros a month without having to work for it.

Since he could not prove that he had made a specific consideration for the salary received from VW, he was asked by the Lower Saxony state parliament president Jürgen Gansäuer to make a payment of € 343,519 to the state on the basis of the law on representatives . Viereck announced through his lawyer that he did not want to repay the additional income. In doing so, he cites having rendered something in return. However, he left open what consideration he had provided. VW confirmed that Viereck had not provided anything in return.

The action for repayment before the Braunschweig Administrative Court was upheld on November 16, 2005. Due to the fundamental importance of the case, however, the possibility of appeal was allowed, which had already been announced by the politician's lawyer.

The Lower Saxony Higher Administrative Court ruled on March 13, 2008 that Viereck had received payments from Volkswagen AG that were forbidden for several years within the meaning of Section 27 (3) of the Lower Saxony Representatives Act (NAbgG) and therefore had to transfer the amounts received to the State of Lower Saxony.

The appeal to the Federal Administrative Court has not been allowed. The non-admission complaint lodged against this was rejected on August 29, 2008 by the 6th Senate of the Federal Administrative Court.

On April 28, 2005 he announced his resignation from the office of mayor and the chairman of the sports committee of the city of Wolfsburg due to public pressure.
