Karlheinz Merkel (born October 13, 1955 in Hof (Saale) ; † May 24, 2020 there ) was a German lawyer .

Career

Merkel studied philosophy, sociology and law at the Free University of Berlin. From 1984 to 1986 he completed his legal clerkship in Berlin and San Francisco.

He has been working as a lawyer since 1986, initially in Berlin and since 1995 in Hof. During his time in Berlin, he worked as an advisor to Bündnis 90. For the civil rights groups "Demokratie Jetzt" and "Initiative Frieden und Menschenrechte" (Peace and Human Rights Initiative), he brought a lawsuit to the Federal Constitutional Court against the unchanged application of the 5% threshold clause for the first all-German federal election on December 2, 1990 . In September 1990, the Federal Constitutional Court declared the application of the 5% threshold clause to the territory of the former GDR in the first all-German elections to be inadmissible; unique in the history of the general election. The Greens (West) failed because of the 5% threshold clause, which remained unchanged in the West. The civil rights activists from the East (Alliance 90 / Greens) came to the first all-German Bundestag with an overall result of 1.2% and 8 members under the leadership of Wolfgang Ullmann .

In 1991 and 1992 Merkel was a member of the constitutional committee of the state of Brandenburg, which drafted the Brandenburg state constitution , which came into force on August 21, 1992. In 1996 he completed his doctorate with the title: "The people's constitutional power (foundations and dogmatics of Art. 146 GG)".

He was a member of International Law Firms with attorneys in Africa, America, Asia and Europe.

Merkel was chairman of the supervisory board of the Hof building cooperative.

Merkel was married and had a son. He lived and worked in Hof an der Saale.
