In connection with the two Swiss (half) Canton Appenzell Outer Rhodes and Appenzell Inner Rhodes with land division , the division of the former canton Appenzell (Appenzell) meant in a reformed and a Catholic Halbkanton to 1597th

Prehistory of the division of land

In the early 16th century, the Reformation found its first supporters in what was then the canton of Appenzell, especially in the western and northern areas of the canton ("outer Rhodes "). However, no agreement could be reached on introducing the new faith across the canton. After a Landsgemeinde resolution of 1525, a vote was taken in each Kirchhöri (parish) on their future denomination. The defeated minority had to leave the church at the request of the majority, but had the right to settle in a church of their denomination. In some church hearings, however, both denominations were still tolerated (including in the main town of Appenzell ).

The resulting parity canton lasted until, in the course of the Counter Reformation, the minority in the south-east of the canton ("Inner Rhodes"), who remained with the old faith, forced their attempts at recatholization (military alliance with Spain, Capuchins in Appenzell). When the Catholics in the capital Appenzell asked the Reformed to either give up their faith or to move away, they tried to exclude the Reformed from government - they were entitled to do so by law.

The Outer Rhodes agreed to a land division in an extraordinary rural community from 1597, the Kirchhöri Appenzell a few weeks later. With the mediation of arbitrators from other cantons, the land division letter was finally drawn up in autumn 1597, which sealed the division of the canton into two half-cantons: the reformed Appenzell Ausserrhoden ("Land Appenzell der Usseren Rhoden") and the Catholic Appenzell Innerrhoden.

The confessional peace was thus sustainably secured.

The predominance of the Catholic places after their victory at Kappel also affected the division of land. Against this background it is to be understood that the referees z. B. determined that the smaller Innerrhoden was allowed to adopt the seal and coat of arms of the undivided canton, while Ausserrhoden had to create a new coat of arms.

Course of the border

The borderline was determined according to denominational criteria. The majority of the newly created canton border coincided with the border of a Rhode (most of the Rhodes later became the municipalities of the same name).

In some cases the farms were assigned to their owning families according to the denomination ( Trogen , Oberegg ). In Hirschberg the division was not determined geographically, but the farms belonged to either Ausserrhoden ( Reute AR ) or Innerrhoden (Oberegg) depending on the denomination of their respective owners . A change of ownership could therefore also result in a change of canton.

This curious system has been gradually simplified. But it wasn't until the young Swiss federal state asked for clarification in 1870 that today's solution was implemented. Since then, the whole of Oberegg has belonged to Innerrhoden and forms an exclave in the Ausserrhoder region.

The properties of the monasteries on actually extra-Rhodian soil, such as the monasteries Wonnenstein and Grimmenstein , were also allocated to Inner Rhodes .

The land division letter

The federal arbitrators named in the land division letter were:

  • Johannes Keller, Mayor of Zurich (reformed)
  • Niklaus Pfyffer, Councilor of the City of Lucerne (Catholic)
  • Rudolf Reding, Mayor of Schwyz (Catholic)
  • Johannes Waser, Mayor of Nidwalden (Catholic)
  • Jost Pfendler, governor and councilor of Glarus (reformed)
  • Johann Conrad Meyer, Mayor of Schaffhausen (reformed)

The composition of the arbitral tribunal was therefore equal. Pfyffer, Reding and Waser (from the Catholic estates) also bear the title Bannerherr (Pannerherr), and Reding and Waser also have the title Knight. These titles emphasize their belonging to the nobility or patriciate. This is possibly in connection with the traveling, i.e. the mercenary services for foreign masters, which was organized by the Catholic patriciate and sometimes earned him not only commissions but also titles.

The dating of the land division letter (September 8, 1597) was done according to the Gregorian calendar. In 1584 the decision was made for the new calendar (cf. Landbuch Art. 178), which the authorities (including the pastor) had to adhere to from then on. On March 6, 1585, the Federal Diet passed a decision in favor of the new calendar and, after the calendar dispute flared up again (1589), confirmed it again on February 12, 1590. Accordingly, the land division letter must also be dated according to the Gregorian calendar. Only after the division of land on September 8, 1597, the Julian calendar was officially introduced in the new Ausserrhoden state. It stayed that way until the transition to Helvetic Republic in 1798 (see also Age New Year's Eve ).

The Landteilungsbrief contains 17 articles:

  1. The division of the country should not bring the privileges or the federal government at a disadvantage.
  2. The common property falls to Innerrhoden, which has to pay 18,000 pounds to Ausserrhoden for this, with more detailed provisions regarding the hospital and infirmary ; the gun and the annual fees are to be shared.
  3. The Catholics from Oberegg and Oberhirschberg should belong to Inner-, the Reformed to Ausserrhoden and have their place of jurisdiction there, Unterhirschberg should stay with Ausserrhoden.
  4. The Catholics in Stechlenegg and Rhode Hundwil are allowed to join the Appenzell churches and then have their place of jurisdiction there.
  5. The von Gais should belong to Ausserrhoden, but keep their rights to the three common Alps and the common Mendle
  6. Both parts of the assembly should have their messengers as one place and one vote, while Innerrhoden should have the presidency and, in the event of disagreement, their votes should not be counted.
  7. The occupation of the bailiwick should take place for the first time, where necessary, by lot and then alternately.
  8. Innerrhoden should receive banners and seals, Ausserrhoden should have new ones made with differentiation and Innerrhoden should bear half the costs.
  9. Privileges, alliance letters, contracts, etc., which concern the common land, are to be kept in Innerrhoden, but Ausserrhoden should have a key to the archive. As far as Ausserrhoden alone is concerned, it is to be handed over.
  10. When troops are deployed because of the Spanish alliance, no people may be taken away from Ausserrhoden without authorization from the authorities.
  11. In order to maintain religious peace, abuse of any kind should be prohibited.
  12. Everyone in the Land of Appenzell is free to move to another Rhode while observing the provisions of the treaty of 1588.
  13. The Chapel on the Stoss is allowed to decorate the Inner Rhodes according to Catholic custom and hold their pilgrimages there.
  14. All speeches that have been made on both sides because of this division and all unwillingness should be forgiven and each part should bear its costs.
  15. Both parts should stick to their freedoms, rights and customs.
  16. Each part is free to enter into alliances with and alongside other federal locations, but only in accordance with the federal government and with the knowledge of the other locations.
  17. This division should only last as long as both parts like it. They are free to reunite at any time.

The land division letter is written on parchment and has 6 hanging seals.

Its dimensions are 56 × 81.5 cm.

The land division letter is in the State Archives Appenzell Innerrhoden GIb2a / State Archives Appenzell Ausserrhoden Ac.046.

For the time being, the two parthygen give themselves up to the mocked separation and division, then the same division should be taken in the name of God and directed to work in such a way that our love is now being poured from the outer Roden, with the names Urneschen, Herisow, Hundtwylen, Tüffen and Trogen sambt, which from Gaiß and iren enjoy their own regiment and sovereignty for themselves with council, gricht and right, hochgricht, stick and gallows, also lower grichten, sambt what may belong to an orderly, formal and perfect government, to the best of their ability Place and end, since it comes to be synonymous in the interior, according to ires landts fryities, right and harkhommen employ, lead and have, glychergstalt like ire mitlandtlüt from the kilchhöri and inner clearing which is partly also having and leading, and yet everything else is not then alone to distinguish one and but not to separate from one another, but to be called my own country, also to add an upper division to one another iden share in all the privileges and piety of the high and lower courts and other rights and pardons, so the land of Appentzell obtained and had from Roman princes, kings and other princes and lords, and in the common Eydtgnossischen pundt, in which the land Appentzell city, In no way disadvantageous, erratic ald harmful syn, special sole privileges, frictions, justice and justice as well as the eydtgnößisch punds itself on both parts too, on the outer clearing as well as the kilchhöri and inner clearing as sambtlich a place and glid the Eydtgnoss creates extend and (should) serve on both parts, without any risk.

For the other important landts Appentzell gmein good, so up to now both parts, those of the kilchhöri and inner clearing and also the outer clearing, with another part and gmein kept and administrate, it syge the rathhuss to Appentzell, hospital, infirmary, züghuss, Brick huts, butchery and different, sambt den gülten, schillinggelt, ligenden gueteren, owed and everything else, so belonging to the spittal, siechenhuss and gmeinen lands, how then everything in the south has been made an accident and an unfortunate rollover, everything and everything, what and Then what that is should our dear ones eydtgnoß von der Kilchhöri and inner Roden toodiennen and by iren handen belyben, but then those of the Kilchhöri and inner Roden are guilty of syn, our dear eydtgnossen from the outer Roden, iren Mittlandtlüten, common for Irish born Part and fairness of the common good of everything (in it one deßen, that the from the outer clearing to the number of the male persons the more en neither the others are, in order to have taken a bill and looked at the whole of the things on both systems) in an open purchase wyß would be addressed to all ze, ze live and volgen ze let named eighteen hundred pounds apply to landlord defense, and the following wyß And measured: namely, so should sy inen, the outer Roden, hand over to the fore-rist and deliver everything that pays and valid letter, so to those who sit inside the Outer Roden, city and the hospital, Siechenhuss and common guot, as vil then That is, since the interest, so declining on the very next saint Martin's day, belongs to the letters of the outer Roden without deduction; The old, decayed, and expiring interest, however, sampt the right amount of money, so uf the luchten in Outer Roden stond, should also assume the inzuochen from the Outer Roden, but in the same way, as vil des syn may, pound on the main sum of the eighth humus exit. According to this, those who are processed by the kilchhöri ought to have all interest and debts, if one is good by the hospital, the hospital and other good things, even though they may run out of five hundred pounds. And as far as half of the total interest and debts to houptguot are concerned, that should also be deducted from those of Outer Roden on the mocked eighty-thief pounds; But what you owe by buying the goods zuo Zwingenstein in the Rhynthal, you should give the Ußroden nüt, but that of the kilchhöri and inner clearing that has to be cleared for yourself. And then what about all that the kilchhöri and inner clearing owed to those of the Ußroden by the eightzechenthussent pounds in bill wyter, that ought to succumb to sy inen, namely on the next-coming Liechtme, five hundred guldin landlüffiger defense in cash and but without interest uf now bemelt zil lay more in cash, waving, the outer clearing is supposed to pinch the inside without any interest, and what then by the eighth enthusiastic pounds wyter ußstendig blybt, that the same everything should from the kilchhöri and inner clearing to liechtmeß of the five-year-olds at least five The deduction of a pound of money must be paid for at the due interest, since a guldin for a pound of money is respected and counted in the payment of the cash value. Welliche Achtzechenthussent pounds which from the Ußroden to erbuwung a rathhusses, Siechenhusses and inn another way according to their use (may) use. Whenever, after this, something of the good guots was found in the written record, made on the dry-end day of the next missing August month and pushed to the floor, which was now not taken into account, and then the floor should be halfway have, besides, a kilchhöri and the inner clearing are compulsory, the beneficiaries in the hospital now and in the future without submitting the outer clearing costs and receive remuneration. But what the special fouls are, so this time in the infirmary to Appentzell, is concerned, since the from the outer stubble from now on should handle, care for and maintain half of the same ailments for more than half a year, yet the other foul underfrushes and bit into them Siechenhuss zu Appentzell are kept without the outer Roden cost and, when you grow the Siechenhuss, then half of the geligers and hussrath, if it is inside, follow the outer Roden in ir nüw Siechenhuss. Anthreffend the coarse gschütz, doppelhaggen and all weapons, as in the Zughuß zuo Appentzell, which should divide the from the kilchhöri and the inner clearing with the Ußroden sambt the bulfer and steinen to glych, as also wyß the frid and jargelt from the cron Franckrych and the legacy of the lower Össterrych and Burgundy, so now derelict and unpaid ußstadt and the legacy of the legged and broken tree in future wyter, under sy beidersyts, which are divided by the kilchhöri and inner clearing and the outer clearing, glych.

Thirdly, when the two parthygen got together a little bit spans because of the two opponents named at the Oberegg and at the upper Hirschberg, so from the old one belonged to Troger Rod and located in the same area, since the majority of them lived in the same two opponents of the catholic religion and the zyt har zuo the kilchhöri and the inner clearing of the land kept and wyter by the same inn love and sorrow ze staan and ze blyben deliberately eager and resolved, the other occupants, however, at mocked two opponents, so the evangelical one religion are pending, by the Troger rod and so hereby by the outer Roden ze staan and ze blyben gantz also earnestly begged, about this we have given this explanation and verdict in consideration of the subject matter, namely that for more peace and ruow each part of the bemelten Obereggeren and Oberhirschbergeren by those, zuo wavichen he begert, belyben sölle and may, so the approx tholischen Oberegger and Oberhirschberger zuo the Kilchhöri and the inner Roden and then the evangelical Oberegger and Oberhirschberger like other inn Trogner rod zuo the outer Roden des Landts Appentzell with right and right and in all other ways serve and belong, with this remote explanation: when a More evangelical, sat on the mocked two opponents, on a catholic of the ends and won, umb what things big or small that were, the should the catholic before land master and council of the kilchhöri Appentzell and there right take, on the other hand a catholic the evangelical Complain in front of the Landtammann and Council of the Outer Roden that they are right to accept and take the resultant decision, even the frefel, so each and every one of those two opponents, at which places and ends and on the goods, because they are ruling on, the same goods owner is the uppermost to be justified and atoned for and to be redeemed now and in advance This only extends to the two opposing Oberegg and Oberhirschberg and wyter, also those on the other Hirschberg in Troger rod, because of which there is no spinning, by the outer clearing for more than a bit hard and sitting in the same way as others in the Ußroden underworffen syn, besides the vilbemelt two religions, Oberegg and Oberhirschberg, everyone by syner religion and kilchgang fryg, undivided and insulted belyben, also the fyrtag as the catholics keep by the native taut, without all danger.

For the fourth time, when the inseßen zuo Stächlenegg, unveer vom Flecken Appentzell and located in Hundtwyler Rod, are so catholic, zuo the Kilchhöri Appentzell and the inner Roden and by the same belyben wellent, should like the same thing, unhindered the outer Roden , which is, however, to the liking of everyone. Because of the freflen and penalties, so every cyt decaying at the place, it should be kept, as it was reported from Oberegg and Oberhirschberg for the sake of the next.

For the fifth, how much the from Gaiß von alterhar to the kilchhöri Appentzell and belong to the kilchhöri and with Rinckenbach a rod, but sidtmalen sy, the uff Gaiß, an own kilchen, are also now all of the evangelical religion and now long zyt and jar by den Ußroden was and kept to the same without inred the kilchhöri Appentzell, so the mocked uff Gaiß should like to belyben after all more than bithar by the outer Roden, to serve the same in all away and who from the kilchhöri Appentzell now addressed to sy abstaan, darnebent but also the mocked ab Gaiß, umb the sy zuo serving the Ußroden, no disadvantage ald demolition bring injustice, so sy von old and bithar with the grazing ires vechs to those of the kilchhöri in the dry alps, also the common one Mendli, by virtue of the old harkhommens and ufgerichter letters and sigles, but especially those from Kilchhöri Appentzell inen, who on Gaiß wyt the southern grazing let him be traced as bitingly neighborly.

For the sixth, in relation to the general daily services, both of the Kilchhöri and the Inner Roden and also the Outer Roden, as a common place of the Eydtgnossschaffs, should decree their councils and send them to each other so that both senders do not agree more How brittle, have been told, and at the next salary, wyl Appentzell is the main stain and origin, also the foremost part of the land and the whole land then bears the name, which is why the days of the kilchhöri and inner Roden have the presidency, so darby should belyben it again, but whether both, the inner and outer roden bottschemmer not be able to glimpse each other in some days, then both agree to stand next to each other and not be tented, as in the lower cases, when double bottschafften uff daily services are, bithar is brittle whitened. But since sy of both parts of the incidental things, so affecting the common land of Appentzell, only one bott creates in my name and costs days send well, that likes sy, so sy comparing it, well, and when send letter to the common land Appentzell is written, and sometimes the landtamman or governor then receives the first letter, he may open it; but the letter or a copy of it should also be sent to the other part of the country without delay and without danger.

For the sibling, besides the landtvogty of the upper and lower Rhyntals, the land of Appentzell had to rule with and besides the other places of the Eydtgnossschektiven, when the occupation of the same landtvogty now in the future will compete according to the order of the land of Appentzell, so should both parts von Kilchhöri and von Ußroden, when you don't want to forget for yourself about it, throw the loose with each other, well I partly the crew of this Landtvogty for the first time, but then both parts of the crew of the Landtvogty under the other let umbgahn.

On the other hand, the reason for the panners and sigels is discouraged, namely that the old panner and sigel of the kilchhöri and the inner Roden belong and belong, and that of Ußroden is also a separate nüw panner and sigel, but with a little differentiation from the other and Let the old panner and sigel make mögint and söllint, since those of the kilchhöri and inner clearing eat half of it, so the nüw panner and sigel will cost, reimburse and pay for the Ußroden. Whatever pains and signs of Kilchhöri Appentzell's content, it belongs to one of the other outer rods, which should give them to action; the old, well-received panners, vendli and characters, however, hanging in the kilchen zuo Appentzell, should hang belyben in them as zuo des gmeine landts.

For the ninth time, all important, artistic and other frivolities, pundtbrief, sayings, contracts, letters, sigels, rödel and other gwahrsaminen, so ot the gmein land Appentzell luthing and serving, too Appentzell by the kilchhöri to the gmeinen Landtsamme deal kept belyben, the outer clearers also given a key to it and, next to them, copied from the religious letters and other letters, also from the land books, but what letters, so the outer clearers together or a rod in peculiarity only touching inside the Kilchhöri Appentzell salary, the same letters should be given to the outside and to those to whom the letters are assigned, to act.

When it comes to drinking, when it comes to our eydtgnoss from the kilchhöri and inner Roden deß landts Appentzell from the assumed Hispanic Meylandic pündtnuss because of a break-out war people and reyß or war campaign ze thuon was minded, so should sy to forbid the irish center, ireland Eydtgnaugten from the outer Roden, the people do not wiggle away, it then with the forewarning, will and permissiveness of the Outer Roden, by native Straaff, like then the Badisch Abscheid, who in the most recent Meyen kept daily output, and other things, too . Likewise, the outer clearing trees in the southern case strictly forbid the irons to tear open by the native.

To instigate both parts and religions in the land of Appentzell to maintain several unity, frid and ruow by iren clergy and preachers should trample, scorn and revile everything from the belief on account of the cantzlen and darnebent with all seriousness abolish, also the secular both sides leave the spiritual of both religions unimpaired and undeveloped and, on the part that has not been kept, the transgressors, sy syen spiritual or worldly persons, are therefore seriously tightened.

For the twelfth time, a lot of people in the country of Appentzell, he syge in the kilchhöri or sat in the outer Roden, fryg zuogelaßen syn, inn one or the other rod of the inner or the outer Ze Zuchen and ze sit according to synem, but the contract, so In the eighty-eighth, the minor number was previously judged by the ambassadors of the twelve places of the Eydtgnossschaft between the Kilchhöri and the Outer Roden, measured all the way. Everyone in the land of Appentzell, he sat in wavy clearing, by synen fryheiten, harkhommen, güteren, stäg, weg and other legal amines, if he had in other clearing, for longer than bithar rüwig belyben, also each one of the other in the kilchgang , crützgengen, walferten, zu merckt and other necessary business and things synen drive away and road safely, uninhibited and uncompromisingly and let go by native taut.

Syn to the dryzechende sölle der Kilchhöri and the inner Roden admitted, the sy the capelles on the shock, alda before zyten the battle is fought, may decorate in irem tasting according to catholic break, but also decide and give away and then ire crützgeng and whale home and frömbd like bißhar thuon, doran sy then should not be hindered or trodden by anyone.

At the end of the fourteen, luter has agreed that all the people involved in this action before and now between, our dear ones eydtgnoss des landts Appentzell, both speaking to each other and speaking against each other, and if there was anger, however, aroused, dead and renamed and syn should and no part in the other unguotem Gedencken, kheiner also the others from the faith according to the Hispanic pündtnuss and current division because of the landts and regiment neither smear, revile, vechden after hatred, but sy allersyts from the inner and Ußroden as good middle country tlüt and brothers in good country thier love and unity in a friendly and friendly way with each other and other actions, apart from any parthyg iren of these past things and actions because of the costs incurred by iro himself.

At the end of the fiftieth, both of the parthyps should be publicly and especially by all other iren letters, sigla, land books, justice and guess fractions outside of this act nicely and use it as a result.

To the sixth, diewil sy, unnser dear eydtgnossen deß landts Appentzell, as far as the regiment and general guot is concerned, become sinner and divided from one another (as reported), then every part, the kilchhöri and inner and also the Ußroden, should be synonymous gfallen fryg staan, for oneself in unification and pündtnuss with and besides other places of the eydtgnoss, but on the other hand then after the knowledge of the eydtgnossischen pundts and with gmeiner Eydtgnoss, know and will, how that of the badisch separates, inn also you know.

And then to the last and last thing is also downgraded and reserved: whether Glychwol is now looking at the change and division of the Landt Appentzell regiment and common guots and is directed to the factory, then the same should not resist and persist any longer, then As long as it is compatible in both parts, that is, the sy solitary change and division over short or long cyt will be lifted and, again, as from age harry in common together, when sy is mutually fundint, the in and common land the change is not useful and were princely, and sy to both share the same thing and therefore would like to compare with each other, all true and harmless.

And when we first put ours, here above verbal remedies the gentlemen landtamman, Hauptlüthen, Rethen, ußschützen and Anwelten unnserer eydtgnoss from Appentzell from both parthygen, the inner and outer Roden, on the rathaus to Appentzell on Saturday, the sixth of September and leave from one article to the other, about it they bothersyts to conceal themselves and differently the decreed from the Ußroden bring everything that has been negotiated to a country community of all the outer robs, then sy against the same thing to blame and agree to submit power was still received, and on the following sundays a complete community of all the Outer Roden gathered the prescribed means for us, and from one article to the other public, had a whole community of the Outer Roden and the Outer Roden having a drink there s everything unanimously and frygwillingly up and accepted, as also glychergstalt the gentlemen landtamman, Hauptlüth, reth and gmeinden of the kilchhöri and the inner clearing through ire anwelt are willing in all means, such as those made by us and described here before each other, approved and in those who let go and darby both have agreed to both for themselves and ire nachkhomen to keep them now and here after, to whom inn all would say too much and instead of ze thuond and darwider no act in thou, everything traditionally, upright, honest and safe.

And that everything has to be granted and true, we have six requested and decreed our own islets (but our and our heirs without harm) publicly denounced these letters of the same kind, each part of which has been given one. Give and end the eighth day of the month of September of the birth of Christ, our dear Lord and Savior, counted fifty hundred, useful and siben jare. "

Reunion?

A later reunification was already mentioned in the land partition letter of 1597:

"Whether Glychwol is now looking at the change and division of the Landts Appentzell regiment and common guots and is being sent to the factory, it should not resist and persist for as long as it is in both parts"

Although the separation and division of the land of Appenzell regiments and common property between them is now being looked at and put into action [put into practice], the same should not always be and last longer than as long as it is to both of them Sharing is pleasing "

The question of reunification is raised again and again - preferably on the occasion of joint celebrations. In Ausser- and Innerrhoden, however, there is largely agreement that reunification does not make sense in the short or medium term. One reason is that the mentalities are perceived as very different. On the other hand, closer cooperation is sought in many areas.
