Luxair Flight 9642 was a scheduled flight of the Luxembourg airline Luxair from Tempelhof Airport to Luxembourg Airport , one on the on 6 November 2002 Fokker 50 crashed shortly before landing.

Course of the accident

The plane coming from Berlin crashed during the approach in a field in Niederanven , only 3.4 kilometers from the destination airport. At the time of the accident there was thick fog . Of the 22 people on board, only one passenger and the captain survived the crash.

It was Luxair's first fatal incident. Since the flight was carried out in code -sharing with Lufthansa , the flight also had flight number LH2420 in addition to Luxair flight number 9642 .

Cause of crash

The cause of the crash is assumed to be human error, as the view of the airfield was very limited. However, there are indications that there is a technical failure.

According to the investigation report, when the tower reported that visibility was the required minimum visibility of 300 meters, the throttle for the engines was set to idle, the landing flaps were brought to the 10-degree landing position and the landing gear was extended. Immediately afterwards, however, the six blades on both propellers turned to an angle of attack that is below the minimum prescribed for the flight and is therefore not intended for an approach. According to the report, this position resulted in a very rapid loss of power and altitude. Seconds later, the left motor failed first, then the right motor. The investigation report leaves open whether the wrong angle of attack (parking position) is due to technical or human error.

Among the victims was the Luxembourg artist Michel Majerus .

The couple Kuhn from Germany , whose son was killed in Luxair crash, filed November 30, 2007, a complaint under Article 34 of the European Convention on Human Rights at the European Court of Human Rights in Strasbourg against the Grand Duchy of Luxembourg an infringement of Article 6 (right to a fair trial) Paragraph 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms , which also includes the right to conclude legal proceedings within a reasonable period. They complained about the inappropriately lengthy length of legal proceedings in the Grand Duchy of Luxembourg. On November 4, 2010, the European Court of Human Rights therefore condemned the Grand Duchy of Luxembourg and fully approved the Kuhn family.

The official investigation produced sufficient information to bring a number of those responsible from the company's staff at the time to justice. The trial began on October 10, 2011. The on-board commander was sentenced to three and a half years probation and a fine of 4,000 euros. The three former general managers of Luxair were acquitted. The three Luxair technicians were sentenced to probation of two and one and a half years, respectively.

In November 2011 it became known that the malfunction that led to the crash in November 2002, which was caused by a defective or faulty component on the aircraft, had been known to Luxair for many years. Despite a request from the aircraft manufacturer in 1994, Luxair did nothing.

In January 2014, the relatives of four passengers from Germany and Luxembourg were awarded compensation between 21,000 and 130,000 euros by a court in Luxembourg. In February 2014, the convict's lawyers appealed against the verdict. In May 2015, a court ruled in favor of compensation totaling 330,000 euros for the surviving dependents.
