Recording service

The recording service (also: recording service ) is a service offered by public broadcasters and private broadcasting companies (also: broadcasters ), their subsidiaries or associated companies. With the recording service, private individuals can order recordings of programs from the current or archived television or radio program.

Scope of the offer

The service includes archive research as well as the production and dispatch of data carriers such as DVDs or CDs. These data carriers are produced individually on request. Some recording services also offer their productions for download. In principle, recordings of every production that has been broadcast and archived can be made and made available. This includes films, series, talk shows, documentaries, magazines, animal programs, nature programs, music programs, sports programs, news programs, theater productions, radio plays or interviews. Exceptions to most of the recording service offers are programs that are already available in stores and productions that are subject to legal restrictions from third parties. Usually z. B. major sporting events (such as FIFA or the IOC), concerts, Eurovision programs as well as feature films and productions from abroad are excluded from recording.

Legal classification

The recording is made and made available on the basis of the copyright restrictions stipulated in Section 53 (1) of the Copyright Act . It is therefore not a question of use of the work contained in the recording that requires approval and remuneration. Making individual copies of a work or having them made is permitted within this framework for one's own scientific use, for inclusion in one's own archive, for one's own information on current issues or for other private use in the case of excerpts or articles that are out of print.

Jurisdiction

The determination of the responsible recording service for broadcast recordings sometimes causes difficulties, especially with co-productions in which more than one broadcasting company was involved. In these cases, recordings are usually only made by the person in charge, i.e. H. mainly responsible for producing broadcasting company. Information on responsibility can be obtained from the recording services or, in the case of films, for example, can be researched on the broadcasters' websites or in online film databases.
