Mustafa Tamimi ( Arabic مصطفى التميمي, DMG Muṣṭafā at-Tamīmī ; born 1983 ; died December 10, 2011 in Nabi Salih , West Bank , Palestinian Territory ) was a 28-year-old Palestinian taxi driver who died after being shot at with a tear gas grenade by the Israeli army during a demonstration on December 9, 2011 . The tear gas grenade was fired from an armored military vehicle at which he threw stones. The Israeli army said he threw a stone when it was aimed and that the soldier who fired the shot saw no people in the line of fire and will not be held criminally responsible.

Residents of the village of Nabi Saleh had demonstrated against the settlement since the Israeli settlement of Halamish was built in 1976. The demonstrations intensified in 2009 after settlers claimed a source of fresh water that had previously supplied the village. The demonstrations, in which Palestinian youths often took part, were repeatedly broken up by the Israeli army with tear gas. Sarit Michaeli, a spokeswoman for the Israeli human rights group B'Tselem , said she was aware of dozens of cases in which Israeli soldiers and border police, contrary to explicitly established rules, directly shot protesters with tear gas grenades. Mustafa Tamimi was a cousin of Nariman Tamimi, mother of the Palestinian activist Ahed Tamimi .

Course of events

During one of the weekly demonstrations against the occupation of the Nabi Saleh area by the Israeli settlers, Tamini was shot at from the rear doors of an armored military vehicle and threw stones at it. He was hit in the head below the right eye by the tear gas grenade fired at close range. The projectile can be identified in a photo of the incident. According to Israeli activist Haim Schwarzenberg, Tamimi fell after being hit. His friends rushed to his aid and covered his bleeding face with a black and white patterned Palestinian kerchief. He was taken to Beilinson Hospital in central Israel, where he succumbed to his injuries the following day.

Thousands of Palestinians attended Tamini's funeral, to which his body, wrapped in a Palestinian flag, was brought from Ramallah hospital to the West Bank village of Nabi Saleh, 10 kilometers north. The participants showed posters with pictures of Tamimi's injuries, which were also posted on the monuments in the central plazas of Ramallah. The memorial service ended violently. Israeli soldiers fired tear gas grenades when stones were thrown at them and tried to scare away protesters with skunk , a non-lethal, foul-smelling chemical liquid. Four Israelis and two foreign activists were arrested. Six people, including Israeli activist Jonathan Pollack , were injured at the funeral.

The Israeli army announced that it was investigating the incident. In her first statement, she said that Tamini had thrown stones at IDF soldiers. A later investigation revealed that the soldier had not seen anyone in the line of fire and was not being held criminally responsible. The soldier could not see Tamini clearly and did not aim the tear gas grenade at him. The Israeli human rights group B'Tselem questioned the legality of the soldierly act, as he could not ensure that no injuries would result. The IDF said it was unable to reconstruct what was going on on the ground because stones were thrown at the investigators. Tamimi's brother, Louai, questioned the investigation because the investigators had not questioned him even though he was only 4 to 5 meters from the armored vehicle when the shot was fired. Speaking to Reuters, he said there was no doubt that the soldier saw her and met his brother directly.

The IDF spokesman said a Palestinian eyewitness refused to testify. The photo of the incident shows that Tamimi ran to the military vehicle, the tear gas gun was visible on the rear doors, the grenade was in the air, and then Tamini fell on the ground and injured his face. According to B'Tselem, the fact that it took the military two years to reach a decision, even though the incident was well-documented, shows the failure of the military investigation system. B'Tselem also said the military’s decision was inconsistent with tear gas use rules.

Controversy

Tamimi's supporters accused the Israeli soldiers of using excessive force in dealing with the protester, delaying the arrival of the ambulance and keeping his family and others away from him. Tamimi's death and the photo, which is said to show the moment before he was hit, raise concerns about the use of force by the Israeli military in action against Palestinian protesters. Human rights groups questioned whether the units obeyed the military rules for demonstrations. The widespread photo gives the impression that the Israeli soldier aimed directly at Tamini.

The Telegraph wrote that Israeli military officials had made almost no move to apologize and attempt to prove that Tamimi threw stones by showing photos of a slingshot that they said had been found on Tamimi’s body has been. Some of the officials defended the army on Twitter , blaming Tamini, including Peter Lerner, the then spokesman for the IDF Central Command, whose Twitter commentsparked the greatest outrage,according to The Telegraph , anda storm of indignationaccording to Yedioth Ahronoth . "What was Mustafa thinking when he ran after the moving jeep and stones Schmiss # Fail," tweeted Lerner ( Fail is the school grade 5 and in American colloquial language a term thatexpresses extreme stupidity ). Yedioth Ahronoth wrote that Lerner intended to use the word fail in its original sense as failure and that he expressed his joy that Tamimi had a chance of survival after being hospitalized. Lerner later denied any mockery, saying that he did not want to hurt anyone's feelings when hewrote fail , and that fail was addressed to the activists whom he believed were not indifferent to the incident. Describing the death as an individual tragedy with a terrible outcome, Lerner believed that Tamimi had taken an unnecessary risk and that the soldier acted within the scope of his responsibility.
