District Court of Stanislau

The District Court of Stanislau was a court in the city of Stanislau (Polish Stanisławów ; Ukrainian Станиславів / Stanyslawiw ; today Ivano-Frankiwsk ) in the Austrian crown land of Galicia and Lodomeria . The Stanislau District Court began its activity in 1855.

Based on the principles of the constitutions of 1848 and 1849, the judiciary in the Austrian Empire was reorganized. First, in June 1849, the general principles of the court system in the crown lands were approved by Emperor Franz Joseph I , whereupon Justice Minister Anton von Schmerling had plans to organize the judiciary in the crown lands drawn up. Schmerling's proposals for the Crown Land of Galicia and Lodomeria (full name: Kingdom of Galicia and Lodomeria with the Grand Duchy of Krakow and the Duchies of Auschwitz and Zator. ) Provided for the establishment of three higher regional courts, eight regional courts and 168 district courts, with one higher regional court in the city of Stanislau as well a regional court should be established. These plans were subsequently approved by imperial decree on November 6, 1850. The reorganization was accompanied by the abolition of the sovereign courts as well as the patrimonial courts , but in 1854 the authorities established ten courts of first instance in the crown land of Galicia and Lodomeria. The Stanislau District Court began its activity on September 29, 1855.

Stanislau was an important court seat even after the end of the Habsburg Monarchy and was also the seat of various court instances during the German occupation in World War II. Ivano-Frankivsk, now Ukrainian, is also the seat of a district court.

Responsibilities

The Courts of First Instance in Galicia and Lodomeria, i. H. Regional courts or district courts had been established as an appeal authority against the decisions made by the district offices. Their business scope also included district court tasks, whereby district and regional courts, as in the case of the Stanislau district court, could also delegate the issues of district court tasks to district courts. For this purpose, the Stanislau District Court was set up, which started its activities at the same time as the Stanislau District Court.

The Stanislau District Court initially served as a court of first instance for the Stanislau District and Kolomea District. It was also the competent court for civil and criminal matters for the Stanislau district and the court in commercial matters for the Stanislau and Kolomea districts. It also served as a mountain dish for the districts of Stanislau, Kolomea, Czortkow, Tarnopol, Zloczow and Brzezan. In addition, the Stanislau District Court was the investigative court for crimes and offenses for the Stanislau, Halicz and Bohorodczany districts.

With the creation of the Kolomea District Court, the Stanislau District Court lost its jurisdiction over the districts of the Kolomea , Gwoździec , Hordenka , Kuty , Kossów , Peczeniżyn , Peczeniżyn , Obertyn , Sniatyn and Zabłotów district courts as well as its jurisdiction as a commercial court for these courts on January 1, 1876 . On October 1, 1883, however, the judicial districts of Kałusz and Woynilow came to the Stanislau District Court.
