Rolf Schwartmann (* 1965 in Düren ) is a German lawyer .

Life

Schwartmann grew up in Würselen near Aachen .

In 1992 Schwartmann passed the first state examination in law. In 1995, he did his doctorate in Cologne on the subject of constitutional issues relating to the general funding of political parties . After taking the second state examination in 1996, Schwartmann worked as a lawyer and specialist lawyer for administrative law in a Cologne law firm. From 2000 to 2004 he worked as a research assistant at Johannes Gutenberg University Mainz . In 2004 he completed his habilitation in Mainz with a thesis on private business in international economic law . Schwartmann has been a professor for public and international business law at the Technical University of Cologne since 2004 . Since 2006 he has been the head of the Cologne Research Center for Media Law, which he founded, and since 2012 Chairman of the Society for Data Protection and Data Security (GDD).

Act

Schwartmann prepares practice-oriented studies, for example on copyright, ancillary copyright for press publishers or data protection law. In addition, Schwartmann has prepared studies for public clients. In 2009, he prepared an expert opinion for the state government of North Rhine-Westphalia ( participation of press companies in broadcasting in North Rhine-Westphalia - legal opinion on the amendment of Section 33 (3) LMG NRW ), which was incorporated into the amendment of the local media concentration law in 2009.

In spring 2012, on behalf of the Federal Ministry for Economic Affairs and Energy , his research center presented a study on models for sending warning notices by Internet access providers to users in the event of copyright infringements. The result of this study is the “pre-judicial participation model”, which was the subject of an expert hearing in 2012 before the “New Media” subcommittee of the German Bundestag. He was heard on various occasions as an expert in the state parliament of North Rhine-Westphalia and in the German Bundestag, most recently in 2017 on the Network Enforcement Act.

In 2013 he was the second candidate for the office of Federal Commissioner for Data Protection and Freedom of Information .

Since March 2015, he has been a member of the “Platform Security, Protection and Trust for Society and Business” headed by Federal Minister of the Interior Horst Seehofer , especially for the area of data protection within the framework of the National IT Summit . In this capacity, he heads the platform's data protection focus group, which published a white paper on pseudonymisation in accordance with the General Data Protection Regulation in June 2017.

Schwartmann has been a founding member of the “Medien-Digital-Land NRW” advisory board, initiated by the head of the State Chancellery of North Rhine-Westphalia, Nathanael Liminski, since 2018.

On July 18, 2018, Schwartmann was appointed to the Federal Government's Data Ethics Commission by the Federal Cabinet .

Schwartmann is a guest author for the Frankfurter Allgemeine Zeitung and weekly columnist for the Kölner Stadt-Anzeiger and EXPRESS .

He is also a member of the Board of Trustees of the European netID Foundation, which aims to establish a transparent and European alternative to US platforms with the single sign-on standard netID.
