The Soldiers' Overtime Compensation Ordinance ( SMVergV ) is a federal legal ordinance that was issued by the Federal Ministry of the Interior in agreement with the Federal Ministry of Defense and the Federal Ministry of Finance .

Soldiers in grades of the federal salary order A can be granted overtime pay , provided that overtime is performed in the context of a service in the troop service , on the basis of a duty roster or to achieve a result that cannot be postponed and that is bound by deadlines in the public interest . Federal civil servants , on the other hand, are granted overtime pay according to the Federal Overtime Compensation Ordinance.

The remuneration is granted if, firstly, the overtime has been ordered or approved in writing, secondly, for compelling business reasons, it cannot be compensated for by time off work within one year and, thirdly, the working time resulting from the regular weekly working hours by more than five hours per calendar month (minimum number of hours) exceeds.

The remuneration is not granted in addition to foreign service payments or the foreign use surcharge and according to the medical service remuneration ordinance .

A fraction of at least 30 minutes is rounded up, otherwise it is rounded down.

The hourly remuneration for full-time employees since April 1, 2019 is: [outdated]

  1. in grades A 3 and A 4 13.31 euros,
  2. in grades A 5 to A 8 15.72 euros,
  3. in grades A 9 to A 12 EUR 21.60,
  4. in grades A 13 to A 16 29.73 euros.
