Federal Pay Regulations

The Bundesbesoldungsgesetz systems A, B, R and W are in Germany part of the Bundesbesoldungsgesetz Act (BBesG). The offices of federal civil servants and the ranks of the soldiers ( professional soldiers and temporary soldiers ) and their salary groups are regulated in the federal pay regulations A and B. The offices are assigned to the salary groups according to their value ( Section 20 (1) BBesG). The offices of judges and public prosecutors in the federal service, with the exception of the offices of representatives of the public interest in the courts of administrative jurisdiction and their salary groups, are regulated in the federal salary regulation ( § 37 sentence 1 BBesG). The offices of professors and other university members and their salary groups are regulated in the Federal Pay Regulations W ( Section 32 sentence 1 BBesG).

Federal salary regulations A and B

The federal salary regulation A - increasing salaries - and the federal salary regulation B - fixed salaries - are Annex I of the BBesG. The basic salary rates for the grades are shown in Appendix IV . The Federal Salary Regulations A and B are preceded by preliminary remarks in Appendix I of the BBesG. These are divided into the chapters "General preliminary remarks", "Job allowances" and "Other allowances".

The federal salary regulation A consists of the salary groups A 3 (until March 31, 2020: A 2) [outdated] to A 16. The basic salaries of the federal salary regulation A listed in Annex IV are assigned to levels 1 to 8. The promotion to the next higher level takes place according to the service periods in which the requirements-based services were provided, so-called "experience periods" ( Section 27 (1) sentence 2 BBesG). The times result from Section 27 Paragraph 3 Sentence 1 BBesG.

The Federal Pay Regulations B consists of the salary groups B 1 to B 11. The basic salaries of the Federal Pay Regulations B listed in Annex IV are fixed salaries without any steps.

A civil servant in the ministerial bureaucracy only goes through grades B 3 ( Ministerialrat ), B 6 ( Ministerialdirigent ), B 9 ( Ministerialdirektor ) and B 11 (State Secretary) during normal advancement . A soldier only passes through grades B 3 ( Colonel ), B 6 ( Brigadier General ), B 7 ( Major General ), B 9 ( Lieutenant General ) and B 10 ( General ).

Federal Pay Regulations R

The federal salary regulation R is Annex III of the BBesG. The basic salary rates for the grades are shown in Appendix IV . The federal salary regulation R begins with preliminary remarks on official titles and allowances for judges and public prosecutors at the highest federal courts and authorities .

The federal salary regulation R consists of the salary groups R 2 (until 2013: R 1) to R 10. The basic salaries of salary group R 1 (expiring) and R 2 listed in Annex IV are assigned to levels 1 to 8. The promotion to the next higher level takes place according to fixed times ( Section 27 Paragraph 3 Sentence 1 BBesG). Since judges are not subject to any performance evaluation due to their independence from the judges, advancement is not linked to performance that meets the requirements.

The basic salaries in grades R 3 to R 10 are only available in level 1. They are fixed salaries. The basic salary of grades R 3 to R 9 corresponds to the basic salary of grades B 3 to B 9. The basic salary of grade R 10 is slightly higher than the basic salary of grade B 11.

Federal Pay Regulations W

The federal salary regulation W is Annex II of the BBesG. The basic salary rates for the grades are shown in Appendix IV . In addition to the positions of professors, the Federal Salary Regulations W also apply to full-time heads of universities and members of management bodies at universities who are not professors, unless their positions are assigned to salary groups in the Federal Salary Regulations A and B ( Section 32, sentence 3 BBesG). The federal salary regulation W begins with preliminary remarks on allowances, remuneration for professors as judges and official titles.

The federal salary order W consists of salary groups W 1 to W 3. The basic salary of salary group W 1 listed in Annex IV is a stepless fixed salary. The basic salaries of salary groups W 2 and W 3 are assigned to levels 1 to 3. The promotion to the next higher level takes place after seven years of experience in levels 1 and 2 ( Section 32a, Paragraph 1, Sentence 2 in conjunction with Paragraph 3 of the BBesG).

The only office assigned to salary group W 1 is the “professor as junior professor ”, unless he is in salary group W 2. Professors in salary group W 1, if they have proven themselves as university lecturers after three years, receive a non-pensionable allowance of EUR 273.00 per month from the time of the first extension of the civil service contract.

In salary groups W 2 and W 3, in addition to the minimum basic salary, variable performance payments are awarded ( Section 33 (1) BBesG):

  • on the occasion of appointment and stay negotiations
  • for special achievements in research, teaching, further education, art and the promotion of young talent as well
  • for the performance of functions or special tasks within the framework of university self-administration or the university management (e.g. dean , prorector).

history

Until the federal reform of 2006 , the federal pay regulations also applied to the pay of civil servants and judges in the federal states . Since then, the legislative competence for their own civil servants and judges has fallen to the federal states. Since then, all states have issued their own state salary regulations.

Federal Pay Regulations C

The federal salary regulation C was repealed in 2002 and replaced by the federal salary regulation W. Anyone who already held an office in the Federal Salary Code C could either voluntarily switch to the Federal Salary Code W or remain in the Federal Salary Code C. The states were able to set a deadline up to which this federal pay scale could be classified. After that, only the federal salary code W could be classified. The last possible deadline was January 1, 2005.

The federal salary regulation C applied to university teachers (professors, scientific assistants and university lecturers) and comprised grades C 1 to C 4. Grades C 1 and C 2 were increasing grades and corresponded to grades A 13 and A 14, respectively.
