Restricted area

A restricted area is an area where prostitution is prohibited. The reason is often the protection of minors .

Germany

In principle, prostitution is allowed in Germany. The authorities of a federal state can, however, prohibit the practice of prostitution in certain areas by means of an ordinance . The basis of authorization for this is Article 297 of the Introductory Act to the Criminal Code (EGStGB) . According to this, in order to protect youth or public decency , it may be prohibited to pursue prostitution:

  • in principle (i.e. both public and in buildings)
    • in municipalities with up to 20,000 inhabitants throughout the municipality (Art. 297 (1) 2.),
    • between 20,000 and 50,000 inhabitants in whole or in part (sentence (1) 1.-2.),
    • with more than 50,000 inhabitants only for a certain part of the municipality (sentence (1) 1.);
  • on public roads etc.
    • regardless of the size of the community in whole or in part (sentence (1) 3rd),
    • in this case the ban can be limited to certain times of the day .

The term “pursue” includes prostitution itself and also making contact with customers. Infringements can be prosecuted as an administrative offense in accordance with Section 120 (1) No. 1 of the Law on Administrative Offenses (OWiG) or - if the offense is persistent - as a criminal offense under Section 184f of the Criminal Code (StGB) .

Free , according to the aforementioned 297 Art. EGStGB not affected by the bans. However, many municipalities prohibit in local police regulations from addressing prostitutes in restricted areas. A typical formulation is:

"In the restricted area it is forbidden to contact prostitutes in order to arrange sexual acts for a fee."

Violations of these regulations can also be punished as an administrative offense with a warning fee or a fine .

Basic prohibitions

Baden-Württemberg

In Baden-Württemberg , according to the ordinance of the state government on the prohibition of prostitution of March 3, 1976, it is fundamentally forbidden to pursue prostitution in communities with up to 35,000 inhabitants. This means that prostitution is only permitted in around 46 municipalities in Baden-Württemberg. The adoption of individual Sperrbezirk regulations in municipalities over 35,000 inhabitants is on the four regional councils transfer (Freiburg, Stuttgart, Karlsruhe, Tübingen).

Bavaria

In Bavaria , with the ordinance on the prohibition of prostitution, it is fundamentally forbidden to pursue prostitution in communities with up to 30,000 inhabitants . This means that prostitution is only permitted in around 34 municipalities in Bavaria. With the consent of the municipalities, municipalities can be wholly or partially exempted from the ban.

Thuringia

With the Thuringian Ordinance on the Prohibition of Prostitution of April 24, 1992 , prostitution in Thuringia in municipalities with up to 30,000 inhabitants is prohibited. This means that prostitution is only permitted in around ten municipalities in Thuringia. With the consent of the municipalities, municipalities can be wholly or partially exempted from the ban. The authorization to issue restricted areas was transferred to the Thuringian State Administration Office.

Others

Colloquially, the restricted area is sometimes incorrectly referred to as the “ restricted area ”.
