The German Road Traffic Licensing Ordinance ( StVZO ) is a federal statutory ordinance based on Section 6 of the Road Traffic Act , issued by the Federal Ministry of Transport, Building and Housing .

Together with the Road Traffic Regulations (StVO), the StVZO regulated wide areas of road traffic law until 1998.

The StVZO is currently being dismantled and transferred to other regulations. The first step was the revision of Part A with Sections 1–15 ( admission of persons to road traffic ). This part was repealed and replaced by the regulation on the approval of persons in road traffic driving license regulation (FeV) on January 1st, 1999.

The second step concerned the area of ​​the approval of vehicles for road traffic with §§ 24–28, Part IIa and Annexes I – VII, which were deleted from the StVZO on March 1, 2007 and with corresponding changes in the Vehicle Registration Ordinance (FZV ) were transferred. In 2011, some provisions of the StVZO were transferred to the EC vehicle approval regulation. It is planned - when, is still open - a vehicle operating regulation (FBV). With its introduction, the StVZO is to be finally abolished.

Regulatory content

The Road Traffic Licensing Regulations currently still regulate the formal and technical requirements for the licensing of vehicles for use on public roads, paths and squares.

  • Part I deals with the registration of vehicles in general,
  • Part II the operating license and type approval,
  • Part III the building and operating regulations.

The regulations on the type of motor vehicle in §§ 32–62 StVZO are very detailed, but often no longer applicable for most types of vehicle (cars, trucks) due to competing EC directives. The design regulations for other vehicles - especially for bicycles -, §§ 63-67 StVZO, are criticized for regulations that hinder technical progress.

A regular technical inspection of the motor vehicles ( general inspection , abbreviated HU) is prescribed according to § 29 StVZO or Annex VIII. Proof of this is provided by the entry in the registration certificate Part I and the test sticker on the rear license plate.

According to § 17 StVZO, the road traffic authority or the police (within the scope of express responsibility ) can impose the rectification of defects within a period of time and, if necessary, prohibit use (“shut down the vehicle”) or restrict it. Failure to perform the necessary examination within the deadline is a traffic offense (15 to 40 euros).

Old regulations continue to apply

Pursuant to Section 72 (1), older vehicles that were first put on the market before May 5, 2012, will continue to be subject to the regulations applicable at the time of their registration.

History of the title

In the Reichsgesetzblatt 1937 (p. 1215), the original title of the StVZO is in the long version Ordinance on the admission of people and vehicles to road traffic ; Road traffic licensing regulations were given as a short version of the title . The original long title later disappeared from the legal gazettes, while the former short version of the title is now considered the long version and a short title no longer exists. The abbreviation StVZO has remained unchanged since 1937.

The Driving License Ordinance and Vehicle Admission Ordinance today have long-version titles that still refer to the original title (long version) of the StVZO from the 1930s: Ordinance on the admission of persons to road traffic and Regulation on the admission of vehicles to road traffic .
