Quadruple murder by Eislingen

The quadruple murder of Eislingen was a quadruple murder of a couple and their two daughters in the Baden-Württemberg city of Eislingen in 2009, committed by the son of the family together with a school friend. The crime and the subsequent trial attracted considerable public attention.

Sequence of events

The perpetrators, the 18-year-old Andreas H. and his 19-year-old friend Frederic B., attended a business school in Göppingen together . On the night of Maundy Thursday and Good Friday, they murdered H.'s parents, a 57-year-old alternative practitioner and his two-year-old wife, as well as the 24 and 22-year-old sisters, who were both studying education.

On Maundy Thursday evening, April 9, 2009, they first had dinner together at Frederic B's parents. Then they went to the house of H., retired Tatkleidung and shot about 22 pm, the two sisters who were sitting in front of the TV, with a small caliber - gun . The young women were hit by 10 and 9 bullets respectively. The perpetrators used plastic bottles as silencers . After the act, they went to a nearby music pub where the parents were spending the evening and talked to them for about half an hour. They then went back to their parents' house, put on their crime clothes again and waited for the parents to arrive at around 0:30. The father was shot at eight and the mother with three hits. Then they returned to Frederic B.'s house, where they stayed. The next morning they went back to H.'s house, where they allegedly "discovered" the murders, played horror and alerted the police.

Investigations

The two adolescents were targeted by the investigators immediately after the crime, as there were no signs of a break-in and the two behaved strangely during the interrogations. There were also traces of smoke on their hands. On April 17, 2009, Frederic B. made a confession. He showed the investigators the hiding place where the murder weapons were. In October 2008, the two had stolen a total of 17 pistols and rifles and 1700 rounds of ammunition when they broke into the clubhouse of the rifle club , where they were both members. The two friends had already committed several small break-ins since 2007, out of a "thirst for adventure," as Andreas H.'s defender later stated.

The trial began on October 12, 2009 before the 6th youth chamber of the Ulm Regional Court . According to Section 109 (1) sentence 4 JGG, the court could have excluded the public if this had been necessary in the interests of the accused. Instead, due to the great public interest, the youth chamber decided to allow nine journalists selected by name. During the trial, both defendants made a confession. Frederic B. claimed to have fired the fatal shots alone. Andreas H. had planned the act and persuaded his friend to carry it out because he himself had inhibitions. A psychiatric expert at Frederic B. named his platonic love for Andreas H. as a motive , he wanted to deepen the friendship and "weld them together". In the Habgier judgment, Andreas H. was assumed to have wanted to come to the family inheritance alone. In addition, he wanted to free himself from the father who he considered tyrannical.

Andreas H. was sentenced to life imprisonment under adult criminal law, and he was found to be particularly guilty . In the opinion of the criminal law professor Ulrich Eisenberg, the youth chamber has violated the target provision of § 43 para. 2 sentence 2 JGG by specifically appointing an adult psychiatrist instead of a youth psychiatrist as an expert. However, the responsible 1st Senate of the Federal Court of Justice could not find any legal errors in the relevant judgment and rejected the appeal of the defendant Andreas H. with a ruling of November 3, 2010. Although Frederic B. is one year older, he was sentenced to ten years' youth imprisonment sentenced for being diagnosed with a developmental disorder.
