Warnings and process due to penalty interest for small savers in 2017
On December 8, 2017, the judges at the Tübingen Regional Court were concerned with possible negative interest rates (“penalty interest”) for small savers . In a price notice, Volksbank Reutlingen had declared negative interest rates for savings balances possible - but so far no customer has asked to pay. Nevertheless, the consumer protection center of Baden-Württemberg protested and demanded a declaration of discontinuance . Volksbank underlined the penalty interest out of their terms , but also refused to rule out the interest for the future. After a lawsuit by consumer advocates, the court must now negotiate whether the introduction of penalty interest for private customers is permissible or not. Consumer advocates and economists see the case as trend-setting for the banking industry.
After the hearing on December 8th, the Tübingen Regional Court announced that negative interest rates were permitted for small savers on newly created accounts. This is more problematic with old account contracts, argued the judges. The Volksbank lawyer invoked variable interest rates that every account holder accepts when concluding his contract. In times of low interest rates, these could also go into the red. The decisive factor for the judges is whether and when customers would be advised of the possible costs by their bank. New contracts are therefore harmless, as the contracting parties deliberately accepted the corresponding conditions.
If negative interest were charged on old, existing contracts, however, this would be problematic, as it would happen without the conscious consent of the savers. The judgment was published on January 26, 2018; According to this, "general terms and conditions of a bank, with which negative interest rates are introduced for sight, time and fixed-term deposits in relation to consumers, are then ineffective according to Section 307 of the German Civil Code (BGB) if they also include old contracts that were concluded without the customer's obligation to pay." However, the judges pointed out that the case had the potential to even land before the Federal Court of Justice .
