The Association of European Administrative Judges ( AEAJ , dt . : Association of European Administrative Judges ) is an international non-governmental organization that was founded in 2000 and which represents the interests of administrative judges from the member states of the European Union and the Council of Europe as well as their national associations.

The unification was sought on the basis of various initiatives, followed by a meeting in October 1998 at the European Law Academy in Trier . In April 1999 the draft statute for AEAJ was finalized. On March 24, 2000, representatives from Germany , Finland , France , Greece , Italy and Austria founded the Association of European Administrative Judges as an international organization under German law.

aims

The association has the following goals (Article 1 of the statutes):

  • Advance remedies for individuals against public violence in Europe and promote the legality of administrative acts, which will allow Europe to grow together in freedom and justice,
  • to respect the legal cultures in the various member states of the European Union and the Council of Europe on the way to achieving this goal,
  • in order to expand the knowledge of legal remedies in administrative matters at administrative judges in Europe and to have an intensive exchange of information on relevant legal provisions and case law for this purpose,
  • Strengthening the position of administrative judges in Europe that is growing together, and
  • Promote the professional interests of administrative judges at national and European level.

organization

According to Article 3 of the statutes, there are two organs of the association: the general assembly and the board.

General Assembly

The General Assembly (Article 4 of the Statutes) is responsible for all matters that are not assigned to the Board of Directors. In principle, each member has one vote in the General Assembly. If several members come from the same country, this country also has only one vote and the members of the respective country have to agree on how they vote. The general assembly decides whether new members can be accepted (Article 2 of the statutes). The tasks of the general assembly also include the resolution to amend the statutes, the election and supervision of the board, the determination of membership fees, the election of two auditors of the cash balance and the dissolution of the association. Resolutions of the General Assembly are passed with a simple majority. A representative of the European Commission and the Council of Europe may attend the General Assembly as an observer and, subject to their consent, other international legal associations.

Board

The board of directors (article 5 of the statutes) deals with the day-to-day business of the association. The board also represents the association externally (Article 26 BGB). It consists of a President (Edith Zeller, Austria) and at least two Vice-Presidents (in 2017 there were four Vice-Presidents: Rasa Ragulskyte-Markoviene, Lithuania; Bernard Even, France; Holger Böhmann, Germany; Gianmario Palliggiano, Italy). The board members are elected for a period of two years.

The board nominates a general secretary and a treasurer. The general secretary is (2017) Karin Winter from Austria and the treasurer Ralf Höhne from Germany.

Members

According to Article 2 of the statutes, members of the association are associations and natural persons . In principle, membership is open to national associations of administrative judges from all countries that are members of the Council of Europe. If there is no association of administrative judges in a member state, natural persons can also become members. Under certain conditions, individuals can be given observer status without voting rights (Article 2 of the Statutes). Associations are members from Azerbaijan , Bulgaria , Estonia , Finland, France, Germany, Greece, Hungary , Italy, Latvia , Lithuania , Luxembourg , Austria, Portugal , Slovakia , Slovenia , Sweden , Turkey , Ukraine . Individuals are members from: Belgium , Croatia , the Czech Republic , Malta , Montenegro , the Netherlands , Poland , Romania , Serbia , Spain , Switzerland and the United Kingdom (as of 2017).

The association is based at the European Law Academy in Trier.

The association is financed through membership fees, donations and subsidies.
