Foreign graduates in Germany, Austria and Switzerland who have acquired their higher education entrance qualification in Germany are referred to as educational residents; Except in Germany are those who have acquired them at a preparatory college.

The Abitur as well as the Abitur certificate from a German school abroad certifies the general higher education entrance qualification and provides access to any study at universities in Germany as an educational resident.

When applying for a place at a university, if they have a secure residence status, they are treated equally to applicants with German citizenship and German educational qualifications. Educational residents can be better off when it comes to the allocation of study places than foreign students of the same nationality. This is the case, for example, if the chances of getting a place at a university through a foreigner quota system are lower than in the case of an application with a German university entrance qualification. In subjects with a strict numerus clausus , however, foreign students can be preferred if there are relatively generous foreigner quotas in these subjects. In both cases it is a question of “ positive discrimination ” of the preferred.

In the 2006/07 winter semester, the largest group by far among the foreign students were Turks (14,910 students), followed by Croats (3,525 students), Greeks (3,196 students) and Italians (3,145 students). In the 2011/12 winter semester, Turkish students were the largest group with 21,917 students, followed by Italians (4,070 students), Croatians (3,561 students), Greeks (3,429 students) and students from the Russian Federation (3,229 students).

In studies of the success and whereabouts of foreign students , a distinction is often made between foreign students from recruiting countries and those from other countries. Recruiting states are states in which, especially in the 1960s and 1970s, employees (colloquially: guest workers ) were recruited for the Federal Republic of Germany as part of the recruitment policy . These states include: Greece , Italy , Yugoslavia , Portugal , Spain and Turkey .

A special PISA study found that the educational literacy of second generation migrants is lower than that of the first generation. The observer of the UN Human Rights Commission, Vernor Muñoz, sees a particular educational disadvantage in the Federal Republic of Germany .
