Federal Data Protection and Public Information Commission

The Federal Data Protection and Public Information Commission ( French Commission fédérale de la protection des données et de la transparence , Italian Commissione federale della protezione dei dati e della trasparenza ) was an arbitration and appeals commission of the Swiss federal administration within the meaning of Article 71a according to Art. 33 Data Protection Act –C Administrative Procedure Act. Administratively it belonged to the Federal Chancellery . From 2007 the Federal Administrative Court is responsible for the tasks of the commission .

  • Recommendations of the Federal Data Protection Commissioner that concern the private sphere and are submitted to it (Art. 29 Para. 4 Data Protection Act);
  • Complaints against rulings by federal bodies and cantons on data protection issues, with the exception of those of the Federal Council;
  • Complaints against orders of the Commission for Professional Secrecy in Medical Research (Art. 321bis StGB 2);
  • Complaints against cantonal decisions of last instance based on federal public law provisions on data protection.

The judgments can be referred to the Federal Supreme Court .

Members

All members of the commission were elected by the Federal Council for a term of office until December 31, 2007. After that, the members of the Federal Administrative Court were responsible.
