Emissions declaration

Emission declaration is the self-disclosure of a system operator to the competent authority about the type, quantity, spatial and temporal distribution of emissions to a not only minor extent that originated from the system in a certain period of time and about the discharge conditions.

The reported values ​​are the basis of the safety-related system check in accordance with the industrial emissions directive and are included in the emissions register .

Federal Immission Control Act

The operators of systems requiring approval are in accordance with Section 27 of the BImschG obliges to provide information about the type, quantity, spatial and temporal distribution of the air pollution emitted by the system . The content, scope and form of the emissions declaration are regulated in the 11th BImschV .

The emission declaration pursuant to § 27 BImschG must be distinguished from that in the case of emissions trading required emission report ( § 5 TEHG) and the for the Federal Environment Agency led Pollutant Emission Register created to PRTR report ( § 3 SchadRegProtAG).

Content and scope of the declaration

The required content results from the appendix to the 11th BImschV. The information includes emissions-relevant handled substances, processes that cause emissions and the emissions themselves, including certain substances according to TA Luft such as mercury, arsenic, cadmium and nickel, as well as other very toxic substances within the meaning of the Hazardous Substances Ordinance and substances with a comparable toxic effect (Section 3 Para. 1 of the 11th BImschV).

In addition to the master data of the company and the system, the operating time and types of operation (e.g. intended operation, start-up operation, partial load operation, operational disruption / emergency operation) must be specified.

However, an essential part of the emissions declaration is the indication of the emitted substances (Section 5 of the 11th BImschV). These are to be determined by measuring, calculating or estimating (by using the results of comparable systems), whereby the determination procedures are to be regarded as equally important. There are not only targeted active emission processes to be considered, such. B. the discharge of exhaust gases via a chimney , but also passive (e.g. tank breathing ) or diffuse emissions (e.g. dust drifts during cargo handling or blown off heaps and traffic routes).

As a rule, the emission declaration must be submitted in electronic form (Section 3 (3) of the 11th BImschV). The creation and submission then takes place via a web-based software tool (BUBE-Online - operational environmental data reporting). As an exception, a paper version is sufficient. The declarations to be submitted differ only formally, not in terms of content. The system operator can use the help of third parties to prepare an emissions declaration.

The first declaration period for the emission declaration was the calendar year 2008. Every four years, an updated emission declaration must be submitted by May 31 of the year following the declaration period. For 2016, the deadline for declarations ended on May 31, 2017.

Circular Economy Act

Section 41 of the KrWG in conjunction with Section 13 (5) of the Landfill Ordinance (DepV) provides for an annual reportingobligationfor the operators of landfills of certain classes, including on emissions from the landfill surface and gas concentrations in the vicinity of the landfill.

Austria

In Austria, the Industrial Emissions Directive was implemented through an amendment to the Emissions Protection Act. Regulations on emissions declarations can be found in the Emissions Declaration Ordinance.
