In her criticism of the motion for a resolution, MEP Anna Záborská said that the Convention on the Rights of the Child protects children both before and after birth. The ECJ confirmed in a decision ( C-34/10 ) that every human egg from the fertilization stage is a human embryo that needs to be protected.

Treatment in Parliament

The draft of the report was discussed on October 17, 2013 by EU Parliament President Martin Schulz and the political group leaders. It was referred back to the EU Women's and Equality Committee on October 22, 2013 (351 votes to 319, with 18 abstentions).

On December 10, 2013, the motion for a resolution was discussed again in the European Parliament. Parliament rejected the report, stating that "the formulation and implementation of legislation on sexual and reproductive health and related rights and sex education in schools is a responsibility of the Member States." Abstentions accepted.

On January 16, 2014, Edite Estrela tried again to have the report confirmed by the commission. This time too he was rejected. The EU organs, the EU Commission decided, have no right to interfere in questions of abortion policy and sex education and respect the respective legal situation of the national states. According to Parliament, the principle of subsidiarity applies to abortion .
