Guest students are students who attend school in a foreign school district .

Situation in Germany

In federal states that require schools to be in a district , a guest school application must be submitted if the child is to attend a different school instead of the one responsible for his district. Such reasons can be of a pedagogical nature (e.g. if the child were torn from a social environment or the district school does not offer all-day care) or geographical (attending the relevant school would only be possible with disproportionate effort). The school other than the one responsible locally is also in Germany. Attending school outside of one's own federal state is only possible as an exception and is regulated by corresponding contracts of the federal states involved.

The host school relationship is particularly relevant in the city states of Hamburg , Berlin and Bremen , for example, Berlin and Brandenburg signed a host school agreement as early as 1997, which has also provided financial compensation since 2003. The guest school agreement between Hamburg and Schleswig-Holstein and Hamburg and Lower Saxony has enabled a free choice of school regardless of where you live since 2017. The state of Bremen also has a guest school agreement with Lower Saxony, which regulates the conditions under which students can be schooled in the other state.

Since the establishment of a host school relationship, even in countries with host school agreements, is always an individual decision, rejections of host school applications have repeatedly caused a sensation in the past. For example, the rejection of guest school applications to schools in Mainz for pupils from the AKK suburbs or rejection of applications to schools in Berlin for pupils from places near the border in Brandenburg.

Situation in Austria

In Austria there is also a compulsory enclosure, and schooling at a school other than compulsory school requires an enclosure. This umsprengelung must be justified. In Austria, too, reasons can be of a pedagogical or geographical nature. After a written request, the municipality and school management of the host school, the school management of the compulsory school and the municipality of residence must agree to the demolition. The donating community pays the receiving community a guest school contribution to cover the student's costs.

In Austria, sprinkling was usually possible, but lately applications for sprinkling have also been rejected more frequently.

Situation in Switzerland

Switzerland also provides for guest schools, but there is no compulsory district. Accordingly, the host school relationship is only relevant at the canton and external borders. In Switzerland, too, a justification is required to be able to attend a school beyond the cantonal borders. In addition, the receiving and releasing cantons must agree. The host school relationship is also important in the border region with Germany, especially in the Konstanz area, the German school is often closer and more conveniently accessible, which is why a particularly large number of Swiss students are trained at the schools in Konstanz.

Guest students with a stay abroad

In terms of travel law , guest students are those who have a stay of at least three months with a host family ( student exchange ) in another country that is associated with regular school attendance ( Section 651u Paragraph 1 BGB ). For this essential provisions of the applicable package , with the provider of the host school stay as a tour operator shall apply and for any travel defects liable ( § 651i para. 1 BGB). Here, however, the term exchange student is more common.
