A barbecue area is an outdoor area with one or more fire pits that are released for grilling . Often there is also a barbecue hut or a pavilion at a barbecue area .

In the cities there are barbecue areas in parks or park-like areas and on the outskirts. Outside the villages there are barbecue areas on tourist routes (e.g. cycle paths ).

Often barbecue areas are designated and managed by the respective municipalities . Before using such a barbecue area or a barbecue hut, you should register with the responsible local authority . Especially on days with barbecue weather , scheduling the use of permanently installed barbecue areas is essential. In contrast to the free barbecue areas, where you have to take care of a grill or a gridiron yourself , the fixed barbecue areas often have a brick grill with grate, and wooden benches and tables are not uncommon. Food , charcoal , lighter and other utensils must be brought with you, both in free and fixed barbecue areas.

Legal situation

The operation of barbecue areas in Germany is part of the general interest and thus the local self-government from Article 28 paragraph 2 of the Basic Law . The municipality is completely free to decide whether and how it operates or regulates the use of communal barbecue areas. The legal forms of community statutes , police ordinances or general directives in the form of signs only placed on the squares are conceivable for the regulation in barbecue area regulations .

From a legal point of view, in the Federal Republic of Germany a barbecue area with fixed facilities, such as fire places, is a facility that does not require approval within the meaning of Section 3 (5) number 1 of the Federal Immission Control Act (BImSchG). If a municipality operates a barbecue area, it must therefore, in accordance with Section 22 (1) BImSchG, harmful environmental impacts, such as noise and unpleasant smells from barbecue areas, the type, extent or duration of which are suitable for causing significant nuisance for the neighborhood (Section 3 (1) BImSchG) Avoid as far as they can be avoided according to the state of the art and, if this is not the case, to be limited to a minimum. There is no fixed standard.

If there is a barbecue area regulation, this can, for. B. with regard to time limits, can be used as a yardstick for the reasonableness of the nuisance. If necessary, the municipality is required to enforce compliance with the barbecue area regulations by means of police law. Neighbors can force the use of these funds by filing a general performance suit before the administrative courts .
