The basic determination is the first of 9 service phases in the service profiles of property and specialist planning according to the fee schedule for architects and engineers . It follows the preliminary planning .

In Part 1 of VDI 4700 , the basic determination is defined as the first service phase of the HOAI's buildings and interiors service profile. As a comment it says here, quote: "In this phase, the engineer / architect should take care of the requirements for solving the building task. The size and rough layout of the building should be determined. [Based on HOAI]

Colloquially, the basic determination is sometimes equated with requirements planning . This is incorrect with regard to the processes described by the HOAI as a scope of services for planners in service phase 1 in comparison to the definition of requirements planning according to DIN 18205.

Services in property planning

In property planning, buildings and interiors ( Section 34 ), civil engineering structures ( Section 43 ) and traffic facilities ( Section 47 ) are assessed with 2 percent each and outdoor facilities ( Section 39 ) with 3 percent of the fees according to HOAI for the basic determination of the service profiles.

Basic services

The basic services described in Annexes 10 and 11 are almost the same for the buildings and interiors and outdoor facilities :

  • a) Clarification of the task on the basis of the specifications or the requirements planning of the client (or existing planning and approval documents 1) )
  • b) Site visit
  • c) Advice on the entire performance and examination needs
  • d) Formulation of the decision-making aids for the selection of other technical participants in the planning
  • e) Summarize, explain and document the results

For the engineering structures and traffic facilities , the basic services are listed in Annexes 12 and 13:

  • a) Clarification of the task based on the specifications or the requirements planning of the client
  • b) Determination of the planning framework and advice on the overall performance requirement
  • c) Formulation of decision-making aids for the selection of other technical participants in the planning
  • d) for objects according to § 41 numbers 6 and 7 that require structural planning: clarification of the task also in the area of ​​structural planning 2)
  • e) Site visit
  • f) Summarize, explain and document the results

1) Supplement only included in the scope of services for outdoor facilities . 2) Basic service only included in the engineering structures service profile.

The services mentioned in the special services category , i.e. services that have to be paid for separately, differ in all service profiles. In performance image building and interiors are listed as the following services:

Services in specialist planning

The service profiles structural planning ( § 51 ) and technical equipment ( § 55 ) of the HOAI (2013 version) are summarized under specialist planning . In the structural engineering service profile , the basic determination is rated at three percent and in the technical equipment service profile with two percent of the total fee of the HOAI 2013.

Basic services

The basic services of service phase 1 are named in Annex 14 for the structural engineering service profile :

  • a) Clarification of the task based on the specifications or the requirements planning of the client in consultation with the property planner
  • b) Compiling the planning intentions influencing the task
  • c) Summarize, explain and document the results

The basic services of service phase 1 are named in Annex 14 for the technical equipment service profile:

  • a) Clarification of the task based on the specifications or the requirements planning of the client in consultation with the property planner
  • b) Determination of the planning framework and advice on performance requirements and, if necessary, on technical development
  • c) Summarize, explain and document the results

Special services

The following are mentioned as special services of the service profile technical equipment :

  • Participation in the requirements planning for complex uses to analyze the needs, goals and restrictive conditions (costs, deadlines and other framework conditions) of the client and important parties
  • Inventory, graphic representation and recalculation of existing systems and system components
  • Data acquisition, analyzes and optimization processes in the inventory
  • Performing consumption measurements
  • Endoscopic examinations
  • Participation in the elaboration of claims and preliminary examinations for planning competitions

Comparison: Services of specialist planning to those of property planning

When comparing the basic services of specialist planning with those of property planning, it is noticeable that the specialist planner does not name the site visit as a basic service. The professional planner is also not remunerated by the HOAI for formulating the decision-making aids for the selection of other technical participants in the planning. This is due to the fact that according to HOAI no integral planning process is provided in the first service phase , but rather the property planner should initially be commissioned alone in order to then bring other planning participants "on board".

Changes in HOAI 2013 to HOAI 2009

For the purpose of clarification, the alternative “Clarification of the task on the basis of the available planning and approval documents” has been added to the outdoor facilities service profile . In practice, outdoor facility planning is also created on the basis of planning statements or planning permits that have already been issued.

Court judgments

In its judgment VII ZR 230/11 of March 21, 2013, the Federal Court of Justice decided that architects are obliged to take into account the client's cost expectations (budget according to DIN 276 ) as part of the basic assessment .

In its judgment VII ZR 55/13 of April 10, 2014, the Federal Court of Justice decided that the architect commissioned with the basic assessment (service phase 1) must fully and correctly advise the purchaser with regard to the approval of the building project. If the architect violates this obligation and for this reason the customer agrees that the architect plans a different building than the one originally intended, the architect is liable to the customer for damages in accordance with § 634 No. 4, §§ 636, 280, 281 BGB Committed.
