Heike Wiechmann (* 1963 in Lübeck-Travemünde ) is a German designer , illustrator and children's book author . Her most successful work is the "Birthday Train" candlestick, which in 2013 also made legal history.

life and work

Heike Wiechmann started drawing as a child. She first studied pedagogy and then children's book illustration at the Hamburg University of Applied Sciences .

After a few years as a designer and product manager for a toy company, she became a children's book illustrator in 1997.

Wiechmann has illustrated over 40 children's books by other authors, including those by Anne Bachner and Julia Boehme , and contributed the cover illustrations for others. In 2010 she published her first self-written children's book. Her 15 children's books are aimed primarily at first-time readers . Wiechmann's books are published by Loewe , Carlsen , Arena and Ravensburger , among others . Heike Wiechmann also draws cartoons on women and health issues.

Wiechmann lives in Lübeck . From May 2018 she was a member of the citizenship of the Hanseatic City of Lübeck for the electoral community “The Independent” . In August 2019, she gave back her mandate because there was not enough time for her freelance work.

She is a founding and honorary member of the illustrator organization .

In 1998 Wiechmann designed a table decoration for children's birthdays called "Birthday Train" for the wooden toy manufacturer Gollnest & Kiesel ("Goki"). This consists of a wooden locomotive and several wagons on which numbers and candles can be attached. The plaintiff received a total fee of 400 DM for this design and another one. The birthday train became the most successful Goki product and developed into a best seller. Wiechmann therefore considered the agreed remuneration to be too low and, supported by the ver.di union , filed a lawsuit for payment of further appropriate remuneration in accordance with the so-called bestseller paragraph ( § 32a UrhG ).

After both the Lübeck Regional Court in 2010 and the Schleswig Higher Regional Court had dismissed the lawsuit in 2012, arguing that the design as an applied art could not be protected by copyright but only by design law, the Federal Court of Justice decided in 2013, turning away from a case law developed by the Reich Court in 1911 and on appeal on the designs directive for the defendant. It was only since the so-called “ Birthday Train Judgment ” that the same protection threshold for applied art as for so-called pure art has applied in German copyright law .
