Heinz Such

Heinz Such (born August 23, 1910 in Frankfurt am Main ; † December 28, 1976 in Leipzig ) was a German legal scholar who co-founded the socialist civil and commercial law of the GDR .

Life

Such studied law and economics in Berlin and Leipzig from 1930 to 1933, initially without a degree. As a member of the KPD , political reasons for dropping out were decisive. He then worked in the insurance industry until he was drafted into the armed forces in 1939 . He was only able to complete his studies in 1946. He did his doctorate with Hans-Otto de Boor at the University of Leipzig with his work on economic planning and liability for material defects in 1948. Until 1949 he was in charge of its administration and read inheritance law , later also other subjects. The Leipzig Faculty of Law saw such a talented young talent and tried to get him a professorship even before his habilitation . In fact, Such was not granted the license to teach until 1965, long after he had taken over a civil law chair in Leipzig in 1951. From 1969 he held a chair for socialist business law. From 1956 to 1959 and from 1967 to 1973 Such was President of the Arbitration Court of the Chamber for Foreign Trade of the GDR . In 1967 he was elected a full member of the German Academy of Sciences in Berlin .

The importance of such for the jurisprudence of the GDR lies in the development of its own scientific approach on the basis of dialectical materialism . The basis of his theory should be the actual living conditions of people. In particular , he was the first to deal intensively with the concept of public property and worked out its content. He also provided essential knowledge for the design of an independent and uniform socialist economic law, i.e. the legal relationships between companies. He also developed an independent contract theory and the conception of civil law in the GDR, which was intended to overcome the system of Roman law that was regarded as outdated. In his early works, the search, which was also regarded as idiosyncratic, tried to curb the SED's access to all areas of business and science. After he was reprimanded for this in the course of the Babelsberg conference in 1958, he could only avoid more severe consequences through self-criticism.

In 1957 Such was awarded the National Prize of the GDR .
