Hubert Haderthauer (* 1956 ) is a German psychiatrist . The husband of the CSU politician Christine Haderthauer is a district court doctor at the district court of Ingolstadt . The couple has been married since 1985, has two grown children and lives in Ingolstadt.

Haderthauer came into the focus of public reporting in 2014 in the course of the model car affair . Both spouses are affected by this, since from 1990 to 2004 initially Christine and then from 2004 to 2008 Hubert Haderthauer worked as managing partners for the civil law company Sapor Modelltechnik , whose business the affair goes back to. Obviously, the company was able to start its activity mainly because Hubert Haderthauer was in 1990, as a doctor, responsible for the “work therapy model making” in the Ansbach district hospital .

On November 4, 2015, the Munich II public prosecutor brought charges against Haderthauer in connection with the model car affair on suspicion of tax evasion and fraud . Haderthauer defended himself in the process against the fraud allegation, while he admitted at least partially a wrongdoing with regard to the alleged tax evasion in the amount of 44,000 €, insofar as he admitted to having incorrectly stated commission payments of 14,000 €. During the process, a tax investigator invalidated the millions in profits claimed by the media: After 19 years, the company had lost € 107,000. On February 25, 2016, Haderthauer was sentenced to pay 270 daily rates of € 70 each. In its judgment, the court saw the tax evasion, which had been partially admitted, as proven, the fraud not completed, but nevertheless attempted.

The “Modeling” investigative committee set up by the Bavarian State Parliament came to an end in February 2017. The final report of the CSU also clears Hubert Haderthauer of allegations. Unsuccessful lawsuit by the Free State against Haderthauer

Shortly before the affair became known, disciplinary proceedings were initiated against the official Hubert Haderthauer in July 2014 . The reason for this was a lawsuit brought by the Free State of Bavaria against Haderthauer. This concerned fees that Haderthauer had billed for drug screening examinations on behalf of the Free State. Haderthauer had carried out drug screenings on behalf of the Free State of Bavaria and settled them. The Free State demanded that the fees, which had come about in this way since 1991, be returned, arguing that Haderthauer was not a laboratory doctor, but a specialist in psychiatry, and was therefore not allowed to bill according to the fee schedule for laboratory services. The state of Bavaria sued Haderthauer for repayment of the fees in the amount of € 89,000. On February 17, 2016, the Munich Regional Court I dismissed the Free State's action against Haderthauer (Az. O 20894/14). Haderthauer provided the services in question at the request of the court and the public prosecutor. In addition, as the court found, he was entitled to the fee for his expert services regardless of his specialist medical orientation. Because the Free State was aware of all these facts from the outset, which led to the rejection of the lawsuit, the court called the Free State's fee reclaim as “unfaithful”. The Free State of Bavaria then appealed. On July 21, 2016, an appeal was made in favor of Haderthauer.

A year earlier, in the summer of 2013, the press reported criticism of Haderthauer's dissertation from 1986, which, at ten pages, was unusually short, even for the medical field. There was also a suspicion of plagiarism. However , after examining the doctoral thesis, the University of Würzburg came to the conclusion that the suspicion was unfounded. According to the university's report on the allegation of plagiarism, on the contrary, the doctoral thesis was even one of the most scientifically successful papers. It was an elaborate, experimental doctoral thesis using histochemical and biochemical methods. According to the doctoral supervisor, the experimental time required for the work was around 1.5 to 2 years.
