In the so-called model car affair (sometimes inconsistently referred to as the model making affair ), the couple Christine and Hubert Haderthauer have been subject to a series of ethical , official, criminal and tax accusations that have been carefully monitored by the media since 2013 at the latest . The allegations are denied by Haderthauer. The subject of the affair is the company Sapor Modelltechnik , co-founded by Christine Haderthauer in 1990 , which lucratively marketed luxury model cars manufactured by mentally ill offenders in forensic clinics.

What is striking is the central position of Hubert Haderthauer as the psychiatrist responsible for "work therapy model making", his assumption of his wife's share in Sapor after she was elected to the Bavarian state parliament at the end of 2003 , and the fact that Christine Haderthauer became Minister of State for Work and social order, family and women became the employer of her husband, who, contrary to his duty, had never registered his sideline.

In addition, Hubert Haderthauer Sapor Modelltechnik "sold" Sapor Modelltechnik in 2008 without any information or consent of the co-founder, which - after an out-of-court settlement in 2011 - nevertheless caused him to file a criminal complaint for fraud in 2014 .

Media communication

First, No1de Haderthauer model cars were discontinued, then the affair was reported in May 2013 on Ursula Prem's blog , who frequently researched the media-well-known Bavarian psychiatric inmate Gustl Mollath . She also came across the special working conditions in the Straubing District Hospital.

Various media subsequently picked up on these allegations and, at the beginning of July 2014, the attempt by the Haderthauer couple to prevent identifying reporting about Hubert Haderthauer generated particular attention. Previously, the CSU majority in the legal committee of the state parliament had rejected an opposition motion on the affair. At the same time, several media on behalf of Haderthauer received a "press law information letter" from a lawyer with the conclusion that "reporting on Hubert Haderthauer is not permitted". A report commissioned by the parliamentary group Bündnis 90 / Die Grünen Bayern , however, came to the conclusion that the reporting, especially about the people involved, “has a considerable public interest in information” compared to “the interests of Haderthauer on Protection of his personality to withdraw ”.

Sapor model technology

After an entry in the Ingolstadt trade register, Christine Haderthauer was one of three managing partners of a civil law company from May 31, 1990 , the company Sapor Modelltechnik , which had started on January 2, 1990 with "construction, manufacture and sale of high-quality model vehicles". The other two partners were the Frenchman Roger Ponton, who contributed part of the start-up capital, and the engineer Friedrich Sager. At the end of 1992 Sager left again, in 1993 the company's purpose was limited to the "sale of high-quality model vehicles".

The business model stipulated that mentally ill offenders would manufacture exclusive miniature model cars for the low wages of a correctional facility . A forensic patient who had designed the models was of particular importance, initially in the Ansbach District Hospital and from 2000 in the Straubing District Hospital. The models were taken from the forensic clinics by Sapor-Modelltechnik at flat rates and resold for many times over. Up to ten prisoners worked on the mini models, some of them apparently under harsh working conditions.

After the partner Friedrich Sager left the company on December 31, 1992, Christine Haderthauer and Roger Ponton continued the business.

When Christine Haderthauer became a member of the Bavarian State Parliament in October 2003, she left the Sapor company, but transferred her shares to her husband, Hubert Haderthauer, who in January 2004 became a partner in place of his wife - alongside Roger Ponton.

This document - the power of attorney dated October 7, 1993, issued by Roger Ponton (Sapor Modelltechnik) - finally made Christine Haderthauer difficult to explain. It served to enable them to do business on behalf of Roger Ponton without asking for his consent each time. However, the power of attorney only authorized them to manage the company. According to the findings of a legal opinion, this power of attorney was not sufficient to change shareholders (in the case of Christine Haderthauer to Hubert Haderthauer) or even to sell the company Sapor Modelltechnik without the consent of Roger Ponton.

When Christine Haderthauer was appointed Minister of State in the Bavarian State Ministry for Labor and Social Affairs, Family and Women in October 2008 and a. Hubert Haderthauer also took over the technical supervision of the forensic clinics in which her husband had model cars produced, on October 31, 2008, Hubert Haderthauer sold the Sapor company to Heinrich Sandner from Ingolstadt. He also sold Roger Ponton's shares, although he was not authorized or authorized to do so. According to Christine Haderthauer, the Ponton shares were sold without his knowledge, because it was no longer available and only reappeared in 2011. When Ponton found out about the sale in 2011 and asserted his claims, there was finally an out-of-court settlement between Ponton and the Haderthauers on December 6, 2011. They agreed on a settlement of 20,000 euros for pontoon. When Ponton found out from the press what a large number of mini-cars had been made - around 120 by 2008 - and what high prices had been achieved for the sale, he felt cheated and filed a criminal complaint in 2014.

Investigations began by the public prosecutor's office, which in the summer turned into a "model car affair". While Christine Haderthauer stated that her participation in Sapor Modelltechnik was a "financial commitment based on idealism", her former business partners contradicted this. Friedrich Sager told Bavarian television : "It was just about getting the vehicles ready and selling them as quickly as possible, so that the investments come back and that money is made." Roger Ponton said: "You couldn't get a cheaper labor force."

Investigations

Criminal investigation

The public prosecutor's office, which had initially investigated Hubert Haderthauer as part of Ponton's fraud report , applied to the Bavarian State Parliament on July 29, 2014 for the lifting of Christine Haderthauer's immunity. The state parliament did not object, so that the Munich II public prosecutor's office has also been investigating the head of the Bavarian State Chancellery since August 1st . Thereupon the opposition in the state parliament renewed its demand for a parliamentary committee of inquiry and your resignation or your dismissal as minister of state. The employer and Prime Minister Seehofer recently expressed criticism of crisis management and communication and expects the allegations to be resolved quickly.

Tax investigations

At the beginning of August 2014 it became known that on May 21, 2014 the tax investigators had also intervened and carried out a search in the Haderthauers' private house in order to clarify whether the profits of Sapor Modelltechnik against the tax office or the former partner Roger Ponton were deliberately reduced or not .had been kept secret. The documents confiscated gave rise to the suspicion that the profits were significantly higher than the tax authorities had reported. In 2007 at least 86,000 euros and in 2008 around 57,500 euros are said to have been withheld, for a total of around 143,500 euros in revenue.

Here, too, the aim was the debate about the behavior of the minister and an application for dismissal from office. For this purpose, two legal opinions were presented by the opposition, which are supposed to prove that Haderthauer was a partner in the Sapor company for formal reasons beyond the date it specified at the end of 2003. In the plenary assembly of the Bavarian State Parliament on November 27, 2014, it was decided to set up an investigative committee. On December 4, 2014, the “Modeling Investigation Committee” met for the first time. Since then, numerous witnesses have been heard in subsequent sessions. The "Model Construction" investigative committee set up by the Bavarian State Parliament came to an end in February 2017. The final report of the CSU clears both Christine and Hubert Haderthauer of allegations. CSU chairman Florian Hermann is quoted in the media: "That Dr. Haderthauer would have enriched, this short circuit, you can't pull it like that. ”Christine Haderthauer has been rehabilitated and thoroughly washed clean, all allegations have been invalidated.
