“To me this is extremely worrying. The myth that metadata is just a bunch of numbers and not as revealing as the content of real communication was destroyed long ago. This is extremely sensitive information "

- Elizabeth Goitein, Associate Director, New York University School of Law

Since the previous systems “CRISSCROSS” and “PROTON” no longer met the requirements of the NSA and other US services, the creation of ICREACH was initiated in 2006 by NSA boss Keith Alexander .

Legal position

The search engine can be used by analysts from other authorities when it comes to foreign intelligence. Legally, if analysts want to see data collected under the Patriot Act , it must be about tracking down terrorist activity.

Data collection is legitimized by Executive Order 12333 , which came into force in 1981. However, this is also criticized in the USA itself, as it was not intended for use on the Internet due to its age. The presidential decree enables both metadata and content to be saved. This storage of the data is not subject to any judicial control. There are no protective mechanisms for US citizens if their data was recorded "by chance" abroad rather than in the USA. It doesn't matter whether they are suspected of an act or not. There are practically no protective mechanisms for foreign citizens.
