State awards in Austria are given by the Federal Minister of Economics to companies that have made outstanding contributions to the Austrian economy. The award entitles the company to use the Austrian federal coat of arms with a corresponding reference to business papers, pamphlets, business names, etc. The tradition goes back to the kk privileged award of the Austrian Empire .

The right to use the national coat of arms has its roots in the late 18th century. During this time, the custom spread that commercial enterprises that were of outstanding importance for the development of national industry and the stimulation of trade (factories, wholesalers, banks or the like) may have the prerogative of the imperial eagle under the shield and the seal Designation kk  privileged to be used in the company name . This form of state award should not be confused with the imperial and royal purveyors , who were also allowed to publicly use the national symbol of the empire. This was regulated by Joseph II. By ordinance 1787 and court decrees by Leopold II. 1791. It was then also incorporated into the trade regulations of 1859 (GewO) . § 58 GewO 1859 regulated that these award-winning companies were allowed to invoke this state recognition of their performance in foreign traffic.

After the collapse of the monarchy in 1918 and the proclamation of the republic, this state distinction was retained and formally adapted to the new circumstances with an amendment in 1922. In the trade regulations of 1973, the legal basis for the award was regulated in Section 68. In the 1988 amendment to trade law, the word 'national coat of arms' was replaced by the word 'federal coat of arms' in order to do justice to the wording of the coat of arms law (Federal Law Gazette 159/1984). The additional award for training companies for apprentices according to Section 30a of the Vocational Training Act (BAG) has existed since 1993.

Around 2015 there were around 2,400 bearers of the national coat of arms, that is just under percent of all 300,000 companies in Austria.

State award according to § 68 GewO (commercial companies)

According to § 68  (1) of the trade regulations of 1994 , the Federal Minister of Economics can award the award to a commercial enterprise that “has made outstanding contributions to the Austrian economy ” (Paragraph 2, Item 2) and “ nationwide in the relevant branch of industry takes a leading and generally respected position ”(line 3).

A similar award is the state award for training companies , which the Ministry of Economic Affairs can award according to Section 30a of the Vocational Training Act if a company has made particular merits in apprenticeship training .

Loan and use

The legal prerequisites for the award to a company, besides the criteria of exceptional performance, merits to the economy, market leadership and generally respected position, is that it is entered in the commercial register.

The award is given on request. After submitting a corresponding request, the Federal Ministry of Economics will initiate the legally stipulated assessment procedure, among others the Austrian Chamber of Commerce and the Federal Chamber of Labor . The application is associated with a fee.

Only on the basis of the expert opinion and after obtaining information about z. B. the trade license, the particular company performance, history of the company, amount of annual turnover, number of employees, training and economic success, trade information from the credit protection association, etc. will be decided on the application. An administrative fee and other fees are due at the time of the award. At the request of the company and at its expense, the award can be published in the Wiener Zeitung .

The award includes being able to use the federal coat of arms of Austria in business dealings with a corresponding reference to the character of the award "as a head imprint on business papers, on pamphlets and announcements as well as in the external business name and in other announcements". A reference to the state award can often be found, for example, directly on the company sign at the entrance to the company headquarters. However, the federal coat of arms may not be used on the company's products, so it is not a product label .

According to § 68 (4), the Federal Minister may revoke the award if the company disregards the legal requirements (according to paragraph 1) despite warnings.
