The cantonal referendum on "Amendment of the law on public rest days" was a referendum in the Swiss canton of Solothurn that took place on April 24, 2005. The content of the bill was the downgrading of the Federal Day of Prayer from a so-called “major holiday” to a general day of rest.
Nine years later, on January 29, 2014, the Cantonal Council of Solothurn decided to revise the law on public rest days. With a ratio of 69 for to 22 against, the bill was adopted to update the Rest Day Act, lift bans and re-regulate responsibilities. Therefore, the bill reached the referendum on May 18, 2014 and was approved with 61.8% yes-votes.

Background and content

The day of prayer takes place on the third Sunday of September. The Solothurn Autumn Fair (HESO) also takes place towards the end of September . In a few years like 1997, 1998 or 2003 this led to the fact that the fair had to be closed on the day of bed and there was a one-day interruption in the fair calendar. In response to this fact, a motion was submitted in November 2003 which provided for an amendment to the cantonal law on days of rest that had existed since 1964. This has classified the day of prayer so far as one of the "high holidays", which are subject to particularly restrictive restrictions. No trade fairs or exhibitions are allowed to be held on this day. With the change in the law, the day of prayer should be deleted from the list of high public holidays, which would have downgraded it to an ordinary general day of rest and would have made it possible to carry out the HESO on prayer day from 12 noon at the latest. The motion was approved by the Solothurn Cantonal Council in May 2004, but did not achieve the necessary 2/3 majority, which meant that the change in the law was subject to a mandatory referendum.

Proponents argued that the change in the law would benefit not only HESO itself, but also local businesses. If the bill was accepted, the opponents saw a further step in liberalization and poorer working conditions for sales staff. The Solothurn government council rejected the proposal.

Voting result

Six out of ten districts rejected the proposal. The range of yes votes by district was 7.7%. The proposal was rejected with 49.5% yes-votes, which means that the day of prayer was retained as a major public holiday.
