Klaus Bourquain

Klaus Bourquain (* 1938 in Magdeburg ) is a German author of children's books and stories and a former member of the French Foreign Legion .

Life

Born in Magdeburg in 1938, Bourquain fled the GDR to Dortmund in the mid-1950s . There he worked as a beer brewer and milker until he joined the Foreign Legion in October 1959. He was used in the Algerian War. When he wanted to go over to the Algerian Liberation Front on May 4, 1960 , he shot Erich Deisler, who wanted to prevent him from doing so while on a joint watch.

Bourquain was sentenced to death in absentia by a French military tribunal on 1961 for desertion and willful homicide . This judgment was never carried out, however, because after a short stay in Tunisia and the Federal Republic of Germany, he left for the GDR in 1963 . The execution of the death sentence expired in 1981. In 1964, the Dortmund public prosecutor had asked the GDR judiciary to take over the proceedings, but they refused. After various activities in the GDR, he began to write children's books, fairy tales and stories as a freelance writer. After the reunification in the GDR he worked as a geriatric nurse in Güstrow . He later moved to Bavaria, where he also worked as a geriatric nurse.

At the end of 2001 it became known to the judicial authorities that Klaus Bourquain lives in Riedenburg . He was taken into custody in July 2002. On December 11, 2002, the Regensburg public prosecutor brought charges against him for killing Deisler at the regional court in Regensburg for murder in accordance with Section 211 of the German Criminal Code. The regional court referred the case to the European Court of Justice . According to the Schengen Convention , double punishment is not permitted within the European Union. Therefore, the Advocate General of the European Court of Justice Dámaso Ruiz-Jarabo Colomer declared that a second conviction in Regensburg is not permissible. The Court accepted that view.
