Efficient district community

An efficient municipality belonging to a district in Bavaria is a municipality which, through statutory ordinance (Competence Ordinance in the Building Industry, GVBl. 1994, p. 537, BayRS 2130-3-I), has certain tasks of the lower building supervisory authority (building police authority) in the name of the state as its own responsibility ( assigned sphere of activity ) were transferred.
A distinction is made between two groups of particularly productive district municipalities:

  • high-performing municipalities belonging to the county, to which the entire responsibilities of the lower state building inspectorate on behalf of the state have been transferred;
  • efficient municipalities belonging to the district, to which only the responsibility of the lower state building inspection authority for projects of low difficulty has been transferred on behalf of the state.

In addition to the tasks of the lower building supervisory authority, the efficient municipalities belonging to the district are also assigned the tasks of the lower water authority (Art. 63 (1) sentence 3 BayWG). When responsibility is transferred to the municipality, municipalities to which the tasks of the lower building supervisory authority have only been assigned for projects with little difficulty are only assigned the water authority responsibilities to that extent; Otherwise, the District Office, as the district administrative authority, is the water authority (Art. 63 Paragraph 1 Sentence 2 BayWG). If the municipality is the lower building supervisory authority for all projects, its tasks in the field of building supervision and water law are comparable to the major district towns in Bavaria.

There are currently 13 efficient municipalities in Bavaria. These are: Alzenau , Bad Wörishofen , Burghausen , Feuchtwangen , Friedberg , Garmisch-Partenkirchen , Neustadt an der Aisch , Pfaffenhofen an der Ilm , Sulzbach-Rosenberg , Vaterstetten , Waldkraiburg , Waldsassen and Wunsiedel .
