Otto Schwarz (lawyer)

Otto Georg Alexander Schwarz (born January 21, 1876 in Piathen , Insterburg district , † January 29, 1960 in Berlin-Frohnau ) was a German judge .

Life

Born and raised in East Prussia, Schwarz passed his assessor examination in 1901 . During his studies he became a member of the Alemannia Königsberg fraternity in 1894 . In 1906 he became a district judge in Memel (now Klaipėda, Lithuania), four years later he went to Hanover as a district judge , where he became a district judge in 1911 . After the end of the World War, Schwarz received a position as Higher Regional Judge in Breslau (now Wrocław, Poland) in 1919 . In 1926 he was appointed Reich judge in Leipzig , first in the fourth and later in the second criminal senate of the Reich court . From January 1930 he was editor of the Deutsche Richterzeitung . After the end of the German Reich, Otto Schwarz worked from 1945, initially as a district court counselor in Saxony and then in Thuringia . To avoid compulsory membership in the SED , Schwarz resigned from his job and moved from the Soviet occupation zone to Berlin-Frohnau.

In 1933 Otto Schwarz founded two comments on the Criminal Code (continued by Eduard Dreher , Herbert Tröndle and Thomas Fischer ) and on the Code of Criminal Procedure (continued by Theodor Kleinknecht , Karlheinz Meyer , Lutz Meyer-Goßner and Bertram Schmitt ), which have been continued to this day. By his death at the age of 84, Schwarz's Commentary on the Criminal Code had 114,000 copies in 21 editions, while the Commentary on the Code of Criminal Procedure was printed 95,000 times in 22 editions.
