Only posthumously was Robert Erskine confirmed the title of 13th Earl of Mar retrospectively on June 23, 1565.

After December 20, 1400 he had married Lady Elizabeth Lindsay, a daughter of David Lindsay, 1st Earl of Crawford † (1407). With her he had a son and two daughters:

His widow married Sir Robert Keith after his death.
