The Rota of the Apostolic Nunciature in Spain ( Spanish Tribunal de la Rota de la Nunciatura Apostólica en España ; Latin Tribunal Rotae Nuntiaturae Apostolicae in Hispania ; Spanish Rota for short ) is a court of the Roman Catholic Church with its seat at the Apostolic Nunciature in Madrid .

history

A predecessor of the Spanish Rota is documented in documents from the Nuncio Girolamo da Schio from 1529. It was created as a privilege to Spain by Motu proprio of Pope Clement XIV in 1771. It was dissolved in 1932/33 after the Azaña government had withdrawn its civil law competences in marriage matters ; 1947 she was by Pius XII. newly founded.

organization

The current organization of the Spanish Rota is based on standards from 1999. The Rota has seven judges (auditors); one of them is the dean as primus inter pares (norms Art. 2). The cases are each dealt with in a committee (rotation) of three judges (norms Art. 20). The dean presides over the court (norms Art. 18); the nuncio oversees his judgment like a bishop (norms Art. 15). The Rota staff also includes a church attorney (Promotor iustitiae), a defender of the marriage bond or ordination and their deputies (norms Art. 8).

Jurisdiction

The Spanish Rota decides on matters from Spain

  • in the second instance , if the court of a metropolitan diocese or an immediate archdiocese has decided in the first instance (norms Art. 37 § 1 a; cf. can. 1438 n. 2 CIC ); exceptionally also if a suffragan court has decided in the first instance (norms Art. 37 § 3)
  • in the third instance , if a metropolitan court , an interdiocesan court of second instance or the Spanish Rota itself has decided in the second instance (norms Art. 37 § 1 b)
  • in a higher instance (norms Art. 37 § 1 c)
  • exceptionally also in the first instance (norms Art. 37 § 2).

Matters reserved for the Roman courts are excluded (norms Art. 35; cf. cann. 1405, 1445 CIC). The competence of the Spanish Rota is not exclusive; in particular, the appeal can also go directly to the Roman Rota (norms Art. 38).
