Rudolf Stich (lawyer)

Rudolf Stich (born November 5, 1926 in Neustadt an der Haardt ; † June 14, 2012 ) was a German administrative judge and full professor at the University of Kaiserslautern . He made a name for himself in building law with his publications.

Life

Stich was born in 1926 in Neustadt an der Haardt, then in Bavaria. After studying law at the newly founded university in Mainz in the post-war period , he passed the first state examination in 1951. Then, parallel to his legal clerkship, Stich wrote his dissertation Protection of Confidentiality in Administrative Law , with which he obtained a doctorate in 1954 in Mainz. jur. received his doctorate. He then successfully passed the second state law examination on March 4, 1955 and was then hired as a court assessor in the justice department of the State of Rhineland-Palatinate on August 27 of the same year. After a short time in the ordinary jurisdiction, he moved to the administrative court in Neustadt an der Weinstrasse in 1956 , where he worked as an administrative judge for 10 years. In 1966, Stich went to the State Chancellery as a ministerial official and then to the Rhineland-Palatinate Ministry of Culture, where he increasingly dealt with the topics of building planning, building regulations and immission control law. In 1971 he followed a call to the then newly founded University of Trier-Kaiserslautern in the technology department, where he was appointed full professor for “public law, in particular administrative and legal theory of construction, spatial planning and environmental protection”. Until his retirement in 1993, the young, later independent Technical University of Kaiserslautern was involved in the development, most recently in the department of "Architecture / Spatial and Environmental Planning / Civil Engineering".

Stich died in June 2012 at the age of 85 after many years of impaired health.

Stich has made a name for himself primarily through his comments on the building code , the immission control and monument law of the federal and state governments, the state building regulations as well as the nature conservation and state maintenance law of Rhineland-Palatinate. The comments on the Federal Building Act and Urban Development Act, in which he was significantly involved with Otto Schlichter , are particularly well known . After the two laws were merged, Stich published the standard work Berlin Commentary on the Building Code together with the two former presiding judges at the BVerwG, Hans-Joachim Driehaus and Stefan Paetow , which is now in its 3rd edition as a loose-leaf edition.

Honors

In September 1993 he was awarded the Federal Cross of Merit, First Class , by the Federal President .
