The SADC Tribunal ( English SADC Tribunal ) is the Tribunal of the Development Community of Southern Africa (SADC). It has been based in the gym in the Namibian capital Windhoek since it was founded in 2005 .

Originally founded in 1992, the first members of the court were not appointed until 2005. The court began its work on November 18 of that year after Peter Shivute , Chief Justice of the Supreme Court of Namibia , swore it.

The Court of Justice ceased its work in 2010 after all SADC member states agreed to it. In December 2018, the Constitutional Court of South Africa ruled that the consent of the then President of South Africa Jacob Zuma was illegal. This decision must therefore be withdrawn immediately. [obsolete] This would mean that the Tribunal's termination in 2010 would also be inconsistent and would therefore be illegal. In 2012, the Court's work was limited to intergovernmental cases. Until then, only private individuals had called the court, so that its new mandate was de facto of no use.

Important decisions

The court primarily passed judgments against Zimbabwe , which led to the de facto dissolution of the tribunal at the SADC summit in 2010.

The case of white farmer Mike Campbell against the Republic of Zimbabwe attracted public attention . The court ruled in 2007 and 2008 that the land reform was illegal and that the expropriation of the farmer was contrary to Zimbabwe's constitution. It is a de facto discrimination against whites. After the decision, Zimbabwe was eliminated from the tribunal.
