Solicitor General of the Gambia
The Solicitor General of the Gambia (German Attorney General) is a high-ranking attorney for the Gambian government, whose legal system is based on common law . He is the second senior officer in the Justice Department after the Attorney General and Justice Minister . The incumbent Solicitor General as of 2017 is Cherno Marenah .
The function
The Solicitor General is the Assistant Attorney General and has the authority to act on his behalf in his absence. The legal basis for this authority in Gambia can be found in the Law Officers Act . In Gambia, the Solicitor General also serves as legal secretary, practically as state secretary in the Ministry of Justice.
Hassan Bubacar Jallow stated in his book " Journey for Justice " that the Office of the Attorney General is "a peculiarity of the English legal system and a long tradition ". He quotes from 1770 Chief Justice John Eardley Wilmot who said that “ the Solicitor General is the Secondarius attornatus ; and as the courts take legal notice of the Attorney General, if there is one, the Solicitor General, if he is in his place, if there is none, he is a known and sworn officer of the Crown as well as the Attorney, and in the In his vacancy, he carries out every act and every branch of it. "
