The law on the construction and operation of test facilities for testing technologies for track-guided traffic (SpurVerkErprG) was issued in 1976 specifically for the construction and operation of the Transrapid test facility near Lathen in Emsland .

It gained notoriety in the Transrapid accident on September 22nd, 2006 , because the required safety standard for operation with passengers - in particular the route inspection common on high-speed railways - is not provided for by law and the associated ordinances. All that is required is a “paper security” based on manual logs and visual inspections, which cannot rule out human error. The supervisory authority is the Lower Saxony state authority for road construction and traffic . The law expressly excludes the involvement of other specialist authorities in planning and monitoring: Building permits, acceptances, tests and approvals by other authorities do not take place in this respect (Section 11 (3) SpurVerkErprG). With reference to the copyright, the approving authority refuses any publication of the approval and the associated reports .

The specialist knowledge of the Federal Railway Authority (EBA), which is otherwise responsible for high-speed and maglev trains , could not be incorporated.

In contrast to the test track in Emsland, public magnetic levitation train routes in Germany are subject to the General Magnetic Levitation Railway Act (AMbG) monitored by the EBA and the Magnetic Levitation Railway Construction and Operating Regulations (MbBO), both of which give public transport safety a high priority.
