Ulrich Herrmann (judge)

Ulrich Herrmann (born July 2, 1960 in Bonn ) is a German lawyer and presiding judge at the Federal Court of Justice .

Life

He began his professional career in February 1990 after studying and doing his doctorate (with the title The Basic Structure of Lis pendens ) as a trial reporter at the Bonn Regional Court and the local court there . In June 1991 he was seconded to what was then the Frankfurt (Oder) District Court, where, as a presidential judge , he carried out administrative tasks on a large scale in addition to jurisdiction. In June 1993 he was appointed judge for life there. After secondments to the Brandenburg Higher Regional Court and the Ministry of Justice of the State of Brandenburg , he was appointed presiding judge at the regional court at the regional court in Frankfurt (Oder) in November 1995 . In 1998 he returned to work, first by secondment and then as a judge at the Higher Regional Court, at the Brandenburg Higher Regional Court , where, in addition to his judicial work as a presidential judge, he was responsible for personnel matters in the judicial service. From October 1999 to December 9, 2003 he worked at the Ministry of Justice and European Affairs of the State of Brandenburg, where he was appointed Ministerialrat in June 2000 .

Herrmann drew public criticism in the autumn of 2000 in the so-called "office manager affair", in which he was accused of having exerted inadmissible influence on court proceedings as the office manager of Justice Minister Kurt Schelter (CDU) and thereby violating judicial independence by he had put pressure on an express judge under threat of legal consequences. A first attempt in 2002 to have Herrmann elected as a judge at the Federal Court of Justice failed due to fierce resistance from individual legal associations. Both the New Judges' Association and the judges represented in Verdi as well as the working group of social democratic lawyers called for the proposed appointment to be withdrawn.

In contrast, Herrmann was judged by the Presidential Council of the Federal Court of Justice to be “particularly suitable” for the office of federal judge. Despite repeated opposition from the aforementioned legal associations, the election as federal judge took place in May 2003, whereupon Ulrich Herrmann was appointed judge at the BGH on December 10, 2003. Since then it has belonged to the III, who is primarily responsible for official, state and notary liability law, the law of public law compensation and legal disputes over service contracts and agency relationships . Civil Senate , of which he was Deputy Chairman since May 1, 2012. From May 2007 to December 31, 2015, he was also assigned to the Senate for notary matters.
