Uta Foelster

Uta Fölster (born February 9, 1956 in Itzehoe ) is a German judge . She has been President of the Schleswig-Holstein Higher Regional Court since 2008 .

Life

Uta Fölster, daughter of the CDU politician and member of the Schleswig-Holstein state parliament, Heinz-Wilhelm Fölster , grew up with three siblings on their parents' farm in Aukrug . She attended the Klaus Groth School in Neumünster , where she graduated from high school in 1974. After studying law at the Christian Albrechts University in Kiel, she completed her legal traineeship in 1980 in the district of the Schleswig-Holstein Higher Regional Court.

In 1983 she passed the second state examination in law and worked as a probationary judge in Berlin. There she worked as a public prosecutor, civil judge and as a criminal and investigative judge. From 1991 to 1996 she was press spokeswoman for the Berlin judiciary under the SPD Senators Jutta Limbach and Lore Maria Peschel-Gutzeit .

Fölster has worked as press spokeswoman for the Federal Constitutional Court in Karlsruhe and personal assistant to President Jutta Limbach since 1996. After serving as managing director of the Federal Bar Association and the German Association of Judges , she was appointed President of the District Court of Berlin Mitte in 2006. In 2008 she was appointed President of the Schleswig-Holstein Higher Regional Court.

In early 2014, Fölster was seen in the media as a possible new President of the Federal Court of Justice .

On January 30, 2015, Fölster sent an email to the presidents of the Schleswig-Holstein courts. In it, she asked to sign a declaration of confidence with the ailing Justice Minister Anke Spoorendonk (SSW) and her State Secretary Eberhard Schmidt-Elsaeßer (SPD). Fölster drafted the text of the declaration together with the President of the Schleswig-Holstein State Constitutional Court, Bernhard Flor. Several of the other court presidents opposed such a declaration, citing the independence of the judiciary. After the mail traffic became known to the public, the Minister of Justice had the initiation of a disciplinary investigation against Uta Fölster examined. The New Judges Association criticized the initiative by Fölster and Flor, as it was "incompatible with the office of a court president". The aim of the declaration should be "to support the Justice Minister in the political battle of opinion in a targeted manner using the" presidential bonus "and to want to keep her in office". The New Judges' Association also referred to judgments of the Federal Administrative Court and the Federal Constitutional Court . Regardless of the legal situation, such behavior undermines citizens' trust in the independence of the judiciary.
