The Regulation (EU) no. 216/2008 of 20 February 2008 establishing common rules in the field of civil aviation and establishing a European Aviation Safety Agency was the basis of the common European air law and at the same time the central legal basis for action by the European Aviation Safety Agency (EASA). As an EU regulation , it was directly applicable law. Other names are Basic Regulation or EASA Ordinance . Regulation (EC) No. 216/2008 was repealed and replaced by Regulation (EU) 2018/1139 .

Regulation (EC) No. 216/2008 is a new version of Regulation (EC) No. 1592/2002 which already had the same title. With the new version, EASA's competencies have been expanded and binding deadlines have been set for the issuing of the respective implementing provisions . Regulation (EC) No. 216/2008 was repealed and replaced by Regulation (EU) 2018/1139.
Content of the regulation
The regulation deals with two issues, the common rules for civil aviation and EASA. The main objective is the "creation and maintenance of a uniform, high level of civil aviation safety in Europe".
The regulation stipulates that all aircraft except the following are subject to European legislation:
- Historic aircraft
- Experimental aircraft
- Self-construction without commercial intent
- Military aircraft
- Air sports equipment
Since the exempt aircraft are listed in Annex 2 of the Regulation, they are often referred to as Annex II aircraft.
The regulation requires the adoption of implementing provisions and sets general framework conditions for:
- Airworthiness
- environmental Protection
- Pilots
- Flight attendant
- Air traffic controllers
- Authorities
- Training institutions
- Third country operator
The competencies of EASA have been expanded compared to the previous version by:
- staff
- Airfields
- Flight operations
- technical approval and monitoring of air traffic management systems and air traffic control services

Based on Regulation 216/2008, the European Commission has issued a number of implementing provisions in the form of EU regulations:
- Regulation (EU) 1321/2014 - (formerly 2042/2003) Maintenance of the airworthiness of aircraft and aeronautical products, parts and equipment and the issuing of permits for organizations and persons who carry out these activities
- Regulation (EU) 965/2012 - Technical regulations and administrative procedures related to flight operations.
- Regulation (EU) 923/2012 - Common air traffic rules and operating rules for air traffic control services and procedures.
- Regulation (EU) 748/2012 - Implementing provisions for the issuing of airworthiness and environmental certificates for aircraft and associated products, components and equipment, as well as for the approval of development and manufacturing organizations (extended and amended by Regulation (EU) 7/2013).
- Regulation (EU) 1332/2011 - Common requirements for the use of airspace and common operating procedures for on-board collision warning systems.
- Regulation (EU) No. 1178/2011 - Technical regulations and administrative procedures in relation to aircrew in civil aviation (extended and amended by Regulation (EU) 290/2012).
- Regulation (EU) 1034/2011 - Safety oversight in the field of air traffic management and air navigation services and amending Regulation (EU) No. 691/2010.
- Regulation (EU) 805/2011 - Detailed rules for air traffic controller licenses and certain certificates.
